WHEREFORE , the appeal is GRANTED . The Decision, dated October 27, 2017, of the Court of Appeals in CA-G.R. CR HC No. 07835 is hereby REVERSED and SET ASIDE . Accused-appellant ROGER RODRIGUEZ y MARTINEZ alias "ROGER" is ACQUITTED of the crimes charged. The Director of the Bureau of Corrections is ordered to cause his immediate release, unless there exist other grounds for his continued detention. SO ORDERED.
