WHEREFORE , in Criminal Case No. 16-03867 accused Ma. Anacleta Paguirigan Rachelle [ y ] Cueto is found guilty beyond reasonable doubt of Estafa under Art. 315 par. 2(a), of the Revised Penal Code and is hereby sentenced to suffer the penalty of four months and one day of arresto mayor maximum to two years of prision correccional minimum. As to the civil indemnity, accused is ordered to return the amount of one hundred Thousand Pesos (P100,000.00) to private complainant Elizabeth De Los (sic) Tri[ñ]os. Complainant is entitled to an interest at the legal rate of 6% per annum from the date of finality of this judgment until fully paid. As for Criminal Case No. 16-03868, for failure of the prosecution to prove guilt beyond reasonable doubt, accused Ma. Anacleta Rachelle Paguirigan [ y ] Cueto is hereby acquitted of the crime charged. She is however found civilly liable and is ordered to return the amount of six hundred eighty Thousand Pesos (P680,000.00) to private complainant Elizabeth De Los (sic) Tri[ñ]os. Complainant is entitled to an interest at the legal rate of 6% per annum from the date or finality of this judgment until fully paid. SO ORDERED.
