WHEREFORE, PREMISES CONSIDERED, this Court finds the accused, ARIEL PEDROSO y CAIBO, GUILTY beyond reasonable doubt of the crime of Robbery with Homicide as defined and penalized under Article 294, par. 1, Revised Penal Code as amended by R.A. 7659, and hereby sentences him to suffer the penalty of Reclusion Perpetua to Death plus accessory penalty provided by law, and to indemnify the family of the victim, Constantino Lucero, the sum of Eighty Thousand Pesos (P80,000.
WHEREFORE, PREMISES CONSIDERED, this Court finds the accused, ARIEL PEDROSO y CAIBO, GUILTY beyond reasonable doubt of the crime of Robbery with Homicide as defined and penalized under Article 294, par. 1, Revised Penal Code as amended by R.A. 7659, and hereby sentences him to suffer the penalty of Reclusion Perpetua to Death plus accessory penalty provided by law, and to indemnify the family of the victim, Constantino Lucero, the sum of Eighty Thousand Pesos (P80,000.00) as actual damages, and the sum of Three Hundred Thousand Pesos (P300,000.00) as moral damages, without subsidiary imprisonment in case of insolvency, and to pay the cost of suit. SO ORDERED.
