WHEREFORE , the appealed Decision finding accused-appellant BENJAMIN DEL ROSARIO Y NAVARRO guilty of RAPE and sentencing him to reclusion perpetua and to indemnify the victim Ritchie Quisim del Rosario the amount of P50,000.00 as moral damages and to pay the costs, is AFFIRMED. Costs against accused-appellant. SO ORDERED.
