G.R. No. 127489 - THE PEOPLE OF THE PHILIPPINES, VS. ALFREDO GALLEGO, SAMUEL DELLONA, LEOBERT GAJETO, ERWIN VILLAROS, ROBERTO APINAN, TINGTING GAJETO, ERNESTO AROLLADO, JOHN DOE @ “JUN” AND RICHARD DOE @ “DIMAS,” ACCUSED.

Ruling

WHEREFORE, the Court finds the accused Alfredo Gallego, Samuel Dellona, Leobert Gajeto and Erwin Villaros GUILTY beyond reasonable doubt of the crime of Homicide and hereby sentences each one of said accused to suffer imprisonment of TEN (10) YEARS and ONE (1) DAY of Prision Mayor as Minimum to SEVENTEEN (17) YEARS, FOUR (4) MONTHS and ONE (1) DAY of Reclusion Temporal as Maximum and to pay the heirs of the victim, Alexander Adrias, the amount of Fifty Thousand (P50,000.00) Pesos and to pay Eight Thousand (P8,000.00) Pesos for vigil and burial expenses without subsidiary imprisonment in case of insolvency and to pay the costs. SO ORDERED.
