Ruling

WHEREFORE , the Court hereby MODIFIES the decision of the trial court and finds the accused-appellant Joven de la Cuesta y Pararas guilty beyond reasonable doubt of six cases of rape under Article 335 of the Revised Penal Code, as amended by R.A. 7659, and hereby sentences him in each case, to suffer the penalty of RECLUSION PERPETUA , with the accessory penalties of the law; to indemnify the offended party Merma Binasbas y Velasquez in the amount of P50,000.00, plus another P50,000.00, as moral damages and to pay the costs. SO ORDERED.
