WHEREFORE, the Demurer to Evidence filed by the accused is hereby denied for lack of merit. Reviewing further the records of this case, there is evidence and proof that the Demurrer to Evidence fifed by the accused Cristobal is without express leave of court hence, under Section 15 par. 2 of Rule 119, accused Cristobal has waived her right to present evidence and submit the case for judgment on the basis of the evidence for the prosecution .

Reviewing further the records of this case, there is evidence and proof that the Demurrer to Evidence fifed by the accused Cristobal is without express leave of court hence, under Section 15 par. 2 of Rule 119, accused Cristobal has waived her right to present evidence and submit the case for judgment on the basis of the evidence for the prosecution . In view thereof, this case filed against accused Cristobal is hereby submitted for decision. SO ORDERED.
