WHEREFORE, based from the foregoing, this Court renders judgment in this wise: In Criminal Case No. C-97030 for Violation of Section 11, Art. II, R.A.
WHEREFORE, based from the foregoing, this Court renders judgment in this wise: In Criminal Case No. C-97030 for Violation of Section 11, Art. II, R.A. 9165, this Court finds the Accused ABDUL AZIS y SAMPACO a.k.a. MOHAMMAD MACAPUNDAG GUIMBOR @ Major guilty beyond reasonable doubt and is hereby sentenced to suffer the penalty of life imprisonment and fine of Five Hundred Thousand Pesos [P500,000.00]. In Criminal Case No. C-97031 for Violation of Section 11, Art. II, R.A. 9165, this Court find Accused ALIBAIR MACADATO y MACADATO @ Ongkay guilty beyond reasonable doubt and is hereby sentenced to suffer the penalty of life imprisonment and a fine of Five Hundred Thousand Pesos [P500,000.00]. Dura lex Sed lex. The drugs subject matter of these cases are ordered forfeited in favor of the government to be dealt with in accordance with law. In this regard, the Branch Clerk of this Court is hereby ordered to turn over the same to the Philippine Drug Enforcement Agency for immediate destruction in accordance with the provision of R.A. 9165. SO ORDERED.
