Ruling

WHEREFORE, from the foregoing, judgment is hereby rendered in favor of plaintiff [ herein petitioner ] and against defendants [ defendant Willy and herein respondent ]. It is hereby ordered that: Defendants, their assigns and any persons working for or acting under them to immediately vacate the portion of 3,000 square meters of the subject property covered by Tax Declaration No. 99-001-06218 registered in the name of Jose Willy and located at Gusaran, Poblacion, Tuba, Benguet and surrender the possession thereof peacefully to plaintiff; Defendant Caridad Butay to pay plaintiff the amount of Php5,000.00 as monthly rental starting from November 2009 until she shall have finally vacated the subject property; Defendant Jose Willy to pay the amount of Php50,000.00 as moral damages and Php50,000.00 as exemplary damages; Defendants to pay jointly and solidarily pay the amount of Php20,000,00 as Attorney's Fees; and Cost of this suit. SO ORDERED.
