TL;DR — Ruling
WHEREFORE, the appeal is impressed with merit. The Decision a quo is REVERSED and SET ASIDE and a new one rendered as follows: a) Complainant is declared to be entitled to a total and permanent disability equivalent to Grade 1 or the sum of US$60,000.00 payable by all respondents in solidum in peso equivalent at the time of payment; b) He is also entitled to his sickness allowance equivalent to US$2,180.00 (4months) ; c) 10% of the awards as attorney's fees.
Accordingly, the NLRC ordered PAL Maritime to pay Darwin $60,000.00 as permanent disability benefits; $2,180.00 as sickness allowance; and 10% of the total award as attorney's fees, to wit: WHEREFORE, the appeal is impressed with merit.
