WHEREFORE , the petition is hereby GRANTED . The assailed decision of the Court of Appeals dated July 8, 2004 and its resolution dated January 3, 2005 are REVERSED and SET ASIDE . The decision of the labor arbiter dated July 24, 2002 is REINSTATED in toto. SO ORDERED.
