WHEREFORE, the Court finds the herein accused JOSEPH DIZON Y NARIDO GUILTY beyond reasonable doubt of the crime of Rape as defined and penalized under Article 335 of the Revised Penal Code as amended by Republic Act 8353 and is hereby sentenced to suffer the penalty of RECLUSION PERPETUA . WHEREFORE, the Court finds the herein accused JOSEPH DIZON Y NARIDO GUILTY beyond reasonable doubt of the crime of Rape as defined and penalized under Article 335 of the Revised Penal Code as amended by Republic Act 8353 and is hereby sentenced to suffer the penalty of RECLUSION PERPETUA . The period during which the accused was in detention during the pendency of this case shall be credited to him in full provided that he agreed to abide by and comply with the rules and regulations of the Pasay City Jail. Accused is further ordered to indemnify the private complainant, AAA, the amount of FIFTY THOUSAND PESOS (P50,000.00) and to pay the costs. SO ORDERED.
