WHEREFORE, finding the accused Melchor Garcia guilty beyond reasonable doubt of the crime of murder and absent any mitigating or aggravating circumstance, the Court hereby sentences him to suffer the penalty of RECLUSION PERPETUA and to indemnify the heirs of the deceased Roel Diego P4,760,000.00 for loss of earning capacity without subsidiary imprisonment in case of insolvency. Costs against the accused. SO ORDERED.
