Ruling

ACCORDINGLY, in Criminal Case No. 4668-96-C, this Court finds accused Felix Lopez y Javier GUILTY beyond reasonable doubt of the crime of Murder and hereby sentences him to suffer the penalty of DEATH. Accused is further ordered to indemnify the heirs of the victim Mauricio Lanzanas the sum of P100,000.00 as actual damages and P50,000.00 as moral damages. In Criminal Case No. 4667-96, this Court finds accused Felix Lopez y Javier GUILTY beyond reasonable doubt of the crime of Robbery and hereby sentences him to suffer the penalty of Four (4) Years, Two (2) Months and One (1) Day of Prision Correccional as minimum, to Ten (10) Years of Prision Mayor as maximum. Accused is further directed to indemnify the heirs of the victim Mauricio Lanzanas the value of the two (2) radios subject of the offense in the sum of EIGHTEEN THOUSAND (P18,000.00) PESOS. With costs against the accused in both cases. So Ordered.
