WHEREFORE, the court finds the accused RICHARD ESCALANTE guilty beyond reasonable doubt as principal for violation of Section 10(a) of R.A. 7610 in relation to Sec. 3(b), No. 1 & 2, and in the absence of any modifying circumstances, applying the Indeterminate Sentence Law, he is hereby sentenced to suffer the penalty of imprisonment of four (4) years, nine (9) months and eleven (11) days of prision correccional , as minimum, to six (6) years, eight (8) months and one (1) day of prision mayor , as maximum. The accused is likewise ordered to pay AAA the amount of Php50,000.00 as moral damages and to pay a fine of Php15,000.00. SO ORDERED.
