WHEREFORE, the instant petition is DENIED for lack of merit. The assailed Decision of the Court of Appeals dated August 16, 2004 and its Resolution dated July 6, 2005, affirming the Judgment rendered by the Regional Trial Court dated November 26, 1999, are AFFIRMED with the MODIFICATION that the award of moral damages is reduced to P50,000.00. Costs against petitioner.
