TL;DR — Ruling

WHEREFORE, the Decision of the trial court finding appellant Angelito Bagsit y Bagsit guilty of murder qualified by treachery, with the special aggravating circumstance of use of unlicensed firearm and the generic aggravating circumstance of dwelling, and imposing on him the supreme penalty of DEATH, is AFFIRMED with the MODIFICATION that the amounts of P50,000.00 as civil indemnity, another P50,000.00 as moral damages, P25,000.

WHEREFORE, the Decision of the trial court finding appellant Angelito Bagsit y Bagsit guilty of murder qualified by treachery, with the special aggravating circumstance of use of unlicensed firearm and the generic aggravating circumstance of dwelling, and imposing on him the supreme penalty of DEATH, is AFFIRMED with the MODIFICATION that the amounts of P50,000.00 as civil indemnity, another P50,000.00 as moral damages, P25,000.00 as exemplary damages and, in lieu of actual damages, temperate damages of P25,000.00 shall be awarded to the heirs of the victim Pepito Sison. The award of actual damages is deleted for lack of sufficient evidence. In accordance with Art. 83 of The Revised Penal Code, as amended by Sec. 25 of RA 7659, upon the finality of this Decision, let the records of this case be forwarded to Her Excellency, The President of the Philippines, for the possible exercise of her pardoning power. Costs against appellant. SO ORDERED.
