WHEREFORE, finding accused ERLINDO MAKILANG GUILTY beyond reasonable doubt of the crime of RAPE defined and penalized under Article 335 of the Revised Penal Code, without any mitigating and aggravating circumstance, hereby sentences him to suffer the penalty of RECLUSION PERPETUA , and to pay the victim the sum of ONE HUNDRED THOUSAND (P100,000.00) PESOS as moral damages. "No pronouncement as to costs. "The Provincial Warden is hereby directed to commit the person of accused Erlindo Makilang to the New Bilibid Prison, Muntinlupa City, immediately upon receipt hereof.
