WHEREFORE, finding Accused AGAPITO LISTERIO guilty beyond reasonable doubt, he is sentenced: For the death of Jeonito Araque y Daniel in Criminal Case NO. 91-5842, RECLUSION PERPETUA; For the attempt to kill Marlon Araque y Daniel, in Criminal Case No. 91-5843, he is sentenced to six (6) months and one (1) day as minimum, to four (4) years as maximum; As civil indemnity, he is ordered to indemnify the heirs of Jeonito Araque y Daniel the sum[s] of : P54,200.66 as actual damages; P50,000.
