WHEREFORE , the appeal is hereby GRANTED . The assailed Decision is REVERSED and SET ASIDE . Appellant is ACQUITTED on reasonable doubt. Unless convicted for any other crime or detained for some lawful reason, Appellant Warlito Ragon is ORDERED RELEASED immediately.

Unless convicted for any other crime or detained for some lawful reason, Appellant Warlito Ragon is ORDERED RELEASED immediately. The director of prisons is hereby DIRECTED to inform this Court, within five days from notice, of the date and time the appellant is released pursuant to this Decision. SO ORDERED.
