TL;DR — Ruling

WHEREFORE, LTO Department Order 2008-39 is likewise declared NULL and VOID for being UNCONSTITUTIONAL. Consequently, the application for a Permanent Writ of Preliminary Injunction is GRANTED and the LAND TRANSPORTATION OFFICE (LTO), DEPARTMENT OF TRANSPORTATION AND COMMUNICATION[S] (DOTC), and all persons and offices acting in their behalf are hereby directed to CEASE and DESIST from implementing LTO Department Order 2008-39. SO ORDERED.
