WHEREFORE, finding accused SANTIAGO AGSAOAY, JR., guilty beyond reasonable doubt of the crime of rape aggravated by relationship and age, the court sentences said Santiago Agsaoay, Jr., the following: In CRIMINAL CASE No. U-9332, to suffer the penalty of death, to be implemented in the manner provided by law.

Accused is likewise ordered to pay Josephine Agsaoay the amount of P50,000.00 as moral damages, and further sum of P20,000.00 as exemplary damages; In CRIMINAL CASE No. U-9333, to suffer the penalty of death, to be implemented in the manner provided by law. Accused is likewise ordered to pay Josephine Agsaoay the amount of P50,000.00 as moral damages, and further sum of P20,000.00 as exemplary damages. SO ORDERED.
