Ruling

WHEREFORE, premises considered, the instant appeal is hereby DENIED. Accordingly, the assailed Decision dated 21 July 2006 of the Regional Trial Court, Branch 50, 6 th Judicial Region, Bacolod City, in Criminal Case No. 04-26009 is hereby AFFIRMED with MODIFICATIONS. As modified, all three accused are held solidarily liable to pay the heirs of the victim the amounts of Php75,000.00 as civil indemnity, Php50,000.00 as moral damages, Php30,000.00 as exemplary damages and Php25,000.00 as temperate damages. Interest on all damages awarded is imposed at the rate of 6% per annum from date of finality of this judgment until fully paid. SO ORDERED.
