WHEREFORE, premises considered, the Court finds accused Frivaldo Besmonte y Loreno in Criminal Case No. 95-3918 and Sonny Apuyan y Morin in Criminal Case No. 95-3919 guilty beyond reasonable doubt of the crime of Rape under Art. 335 [of the Revised Penal Code] and hereby sentences each of them [to] the penalty of RECLUSION PERPETUA and to pay the sum of P50,000.

WHEREFORE, premises considered, the Court finds accused Frivaldo Besmonte y Loreno in Criminal Case No. 95-3918 and Sonny Apuyan y Morin in Criminal Case No. 95-3919 guilty beyond reasonable doubt of the crime of Rape under Art. 335 [of the Revised Penal Code] and hereby sentences each of them [to] the penalty of RECLUSION PERPETUA and to pay the sum of P50,000.00 each as civil indemnity and P10,000.00 as moral damages to the complainant without subsidiary imprisonment in case of insolvency and to pay the cost. In the service of their sentence, they shall be credited with the full period of their confinement pursuant to law. SO ORDERED.
