WHEREFORE, judgment is hereby rendered, finding both accused(s) Joseph San Jose y Gregorio and Jonathan San Jose y Gregorio GUILTY of the crime of Murder punishable under Article 248 of the Revised Penal Code as amended. Accordingly, accused Joseph San Jose y Gregorio is hereby sentenced to suffer the penalty of Reclusion Perpetua and accused Jonathan San Jose y Gregorio, being entitled to the privilege[d] mitigating circumstance of minority under Article 68 of the Revised Penal Code and applying the Indeterminate Sentence Law is hereby sentenced to suffer the penalty of Ten (10) years and One (1) day of Prision Mayor as minimum to Seventeen (17) years, Four (4) months and One (1) day of Reclusion Temporal as maximum; and, both accused are ordered to indemnify the heirs of the victim in the amount of Php 50,000.00 as death indemnity and Php 50,000.00 as moral damages. No pronouncement as to costs. Both accused(s) are to be credited for the time spent for their preventive detention in accordance with Art[icle] 29 of the Revised Penal Code as amended by R.A[.] 6127 and E.O. 214.
