Ruling

WHEREFORE , the decision of the Regional Trial Court finding appellants Reynaldo Lozada and Geraldine Belleza guilty beyond reasonable doubt of the special complex crime of Robbery with Homicide and sentencing them to suffer the death penalty is hereby AFFIRMED with the modification that they are ordered to pay the heirs of the victim P75,000.00 civil indemnity, P87,303.70 actual damages, P50,000.00 moral damages, and P25,000.00 exemplary damages. In accordance with Section 25 of Republic Act No. 7659, amending Article 83 of the Revised Penal Code, upon finality of this decision, let certified true copies thereof, as well as the records of this case, be forthwith forwarded to the Office of the President for possible exercise of the pardoning power. SO ORDERED.
