WHEREFORE , the petition is GRANTED . The Decision dated August 31, 2011 and the Resolution dated September 6, 2012 of the Court of Appeals in CA-G.R. CR No. 00722-MIN are hereby REVERSED and SET ASIDE . The criminal charges against petitioner Cherry Ann M. Benabaye and her co-accused, Jenkin U. Tupag, in Crim. Case No. 9344, are DISMISSED without prejudice. SO ORDERED.
