WHEREFORE, the Petition is GRANTED IN PART. The decision of the Court of Appeals reinstating the decision of the Labor Arbiter is AFFIRMED with MODIFICATION to the effect that the 21 workers who executed waivers and quitclaims are no longer entitled to back payments. Petitioners are ORDERED TO PAY respondents, except the aforementioned 21 workers, the monetary award as computed, [54] pursuant to the decision of the Labor Arbiter [55] with interest at the rate of 6% per annum from 12 December 2003, the date of promulgation of the Court of Appeals' decision, until the finality of this decision, and thereafter at the rate of 12% per annum until full payment. SO ORDERED.
