WHEREFORE, the decision appealed from is MODIFIED and accused-appellant WILFREDO BAUTISTA y NIELES is declared GUILTY of HOMICIDE, not murder, and sentenced to an indeterminate prison term of six (6) years, four (4) months and ten (10) days of prision mayor minimum as minimum, to twelve (12), years six (6) months and twenty (20) days of reclusion temporal minimum as maximum. In view of the reservation to file separate civil action, no civil indemnity is awarded. SO ORDERED.
