WHEREFORE , the appeal is GRANTED . The January 3, 2018 Decision of the Court of Appeals in CA-G.R. CR-HC No. 09030 is hereby REVERSED and SET ASIDE for failure of the prosecution to prove beyond reasonable doubt the guilt of Macmac Bangcola y Maki. He is hereby ACQUITTED of the crimes charged against him and ordered immediately RELEASED from custody, unless he is being held for some other lawful cause. The Director of the Bureau of Corrections is ORDERED to implement this Decision and to inform this Court of the date of the actual release from confinement of Macmac Bangcola y Maki within five (5) days from receipt hereof. SO ORDERED.
