WHEREFORE, this Court finds accused Yolanda Luy y Ganuelas guilty beyond reasonable doubt of violation of Section 11, Article II, R. A. 9165 and is hereby sentenced to suffer the penalty of imprisonment of twelve (12) years and one (1) day and to pay a fine of P300,000.00 with subsidiary imprisonment in case of inability to pay the fine.

WHEREFORE, this Court finds accused Yolanda Luy y Ganuelas guilty beyond reasonable doubt of violation of Section 11, Article II, R. A. 9165 and is hereby sentenced to suffer the penalty of imprisonment of twelve (12) years and one (1) day and to pay a fine of P300,000.00 with subsidiary imprisonment in case of inability to pay the fine. The illegal drug confiscated from the accused is hereby ordered to be turned over to the Philippine Drug and (sic) Enforcement Agency (PDEA) for disposition in accordance with law. SO ORDERED.
