WHEREFORE, the appeal is DENIED . The Decision dated December 13, 2013 of the Court of Appeals in CA-G.R. CR-HC. No. 01345 finding accused-appellant Eugene Samuya GUILTY beyond reasonable doubt of the crime of Murder, defined and penalized under Article 248 of the Revised Penal Code, as amended, is hereby AFFIRMED with MODIFICATION sentencing him to suffer the penalty of reclusion perpetua , without eligibility for parole, and ordering him to pay the heirs of Gabriel S. Samonte the amounts of P75,000.00 as civil indemnity, P75,000.00 as moral damages, P30,000.00 as exemplary damages, and P25,000.00 as temperate damages, in lieu of actual damages, all with legal interest at the rate of six percent (6%) per annum from the date of finality of this Resolution until full payment. SO ORDERED.
