TL;DR — Ruling

WHEREFORE , the Decision of the Regional Trial Court of Cebu City, Branch 7, finding the accused-appellant guilty beyond reasonable doubt of murder, is AFFIRMED , with the MODIFICATION that the penalty is reduced from death to reclusion perpetua . The accused-appellant Mario Abendan is also ordered, in addition to indemnifying the heirs of the deceased Rizalde Obsiquias in the amount of Fifty Thousand (P50,000.00) Pesos, to pay said heirs moral damages in the sum of Fifty Thousand (P50,000.

WHEREFORE , the Decision of the Regional Trial Court of Cebu City, Branch 7, finding the accused-appellant guilty beyond reasonable doubt of murder, is AFFIRMED , with the MODIFICATION that the penalty is reduced from death to reclusion perpetua . Costs against accused-appellant. SO ORDERED.
