WHEREFORE, since the killing of the victim has been qualified to murder by taking advantage of superior strength, and with the attendant aggravating circumstance of nighttime and none of the mitigating circumstances; accused, Ambrocio Conde, Eleazar Conde, Vicente Conde, Sr., and Eusebio Conde are hereby sentenced to suffer the penalty of RECLUSION PERPETUA, to indemnify the heirs of the victim, Alberto Romero, the sum of Fifty Thousand (P50,000.00) pesos and to pay the costs.

WHEREFORE, since the killing of the victim has been qualified to murder by taking advantage of superior strength, and with the attendant aggravating circumstance of nighttime and none of the mitigating circumstances; accused, Ambrocio Conde, Eleazar Conde, Vicente Conde, Sr., and Eusebio Conde are hereby sentenced to suffer the penalty of RECLUSION PERPETUA, to indemnify the heirs of the victim, Alberto Romero, the sum of Fifty Thousand (P50,000.00) pesos and to pay the costs. Since all the accused are detention prisoners they are given full benefits of the period of their preventive imprisonment to be deducted from the principal penalty. SO ORDERED.
