Ruling

WHEREFORE , the Decision of the court a quo declaring ELEUTERIO DIMAPILIS (also known as Jun, Dakila or Daky ) guilty of rape and sentencing him to death and to pay his victim P500,000.00 in moral damages is MODIFIED ; instead, the accused is held guilty of ATTEMPTED RAPE and is sentenced to an indeterminate prison term of four (4) years and two (2) months of prision correccional medium, as minimum, to ten (10) years four (4) months and ten (10) days of prision mayor maximum, as maximum, and to pay his victim Sharon Degala Salas the sum of P25,000.00 for moral damages and P10,000.00 for exemplary damages. Costs de oficio. SO ORDERED.
