Banzon WHEREAS, in Section 458.1 (ii), 458.2 (vi) and 458.4 of the I-ocil Covernrnent Code of 1991, empowers the sangguniang panlungsod to approve ordinances necessary for an efficient and effective city government and in this connection shall: - Ordinance No. 061 Senes of 2015 Page 3 of I NOW TIIEREFORE, BE IT ORDAINED AS tT IS HEREBY ORDAINED by the SANGUNIANG PANLUNGSOD of MARIKINA, in session, duly assembled to: Section 1. Definition of Terms: Harboring- an act whereby a person gives shelter to violaton of laws or improperly protect illegal vendors 2. Section Prohibiting the harboring or accepting rentals from, or allowing the use of frontage of a residential and commercial establishments of sidewalks, illegal and mobile vendors in all public markets, Marikina Market Zone, private markets and 'lalipapas" within the City of Marikina. Section 3. Any person or persons, entity or entities found harboring or accepting rentals from sidewalks, street, illegal and mobile vendors and allowing the frontage of their residential or commercial establishment to be used for the same activity in all public markets, Marihna Market Zone, private markets and "talipapas" shall be penalized as follows: a) First Offense - a fine ofOne Thousand Pesos (Phpl,000.00) b) Second Offense a fine of Three Thousand Pesos (Php3,000.00) and revocation of business permiVlicense in both instances or imprisonment of Ten (10) days at the discretion ofthe court 4. Section The O{fice of the Market Administrator, Office of Public Safety and Security (OPSS) and the barangay government concemed where said violation was committed are hereby tasked to strictly enforce this Ordinance with the assistance of pNP- Marikina, Business Permits and License Office and City Legal Office. Section 5. Separability Clause- If any provision of this ordinance be declared unconstitutional, illegal or contrary to existing national laws or executive order, the remaining provisions herein shall remain valid and in effect. Section 6. Repealing Clause - All ordinances, resolutions, executive orders or circulars inconsistent with the provisions of this Ordinance are herebv reoealed and,/or modified accordingly. Section 7. Effectivity Clause - This Ordinance shall take effect ten (10) days after its approval and after posting in three (3) conspicuous places within the City of Marikina.
