AYUSON WHEREAS, under Article 4, Section 152, of the Local Government Code of 1991 ,k states that the barangayjnay levy taxes, fees' and charges; WHEREAS, privately-owned companies that cater services or utilities to the public, l!.r. such a; electricity, water, telephone, cable-Tv, and other public places for purposes of repair, installation or expansion, and thus considered as part in the conduct of busjness of said companies; WHEREAS, while these companies are issued excavation permits by the Engineering Office, the barangay government, however, for purposes of public safety' has the need to oversee and monitor occasionally the digging being done within their.iurisdiclion; WHEREAS, similarly, since these excavations are being done within the tenitori jurisdiclion of the barangay, the activity involved on these dig oftentimes causes discomfort and inconvenience on some residents, and which Problem has to be addressed to bY the ba government; WHEREAS, the effects of these excavations on the barangay and its residents and the relative services the barangay government have to extend thereto would justify the imposition of clearance fees to all diggings and /or excavation being doneon Barangay Barangka; Barangay Ordinonce No. 03 Seties of 2000 WHEREAS, additionally, Section 391 (A) of the Locat Government Code provides f s1 nl a , h9-9-"legrnigng Barangay as the tegislative body of the barangay enact tax and revenue ordinances subject to tfre timitatiinl imposed in thjs code; NOW THEREF SO AR NE G, G B UE N TtT A Y otT f tS BA H ME NRE GB KY A O R inD ATNED b -y the session duty assembled, that 1.
