TIILE. This Ordinance shall be known as the " MARIKINA STREETS AND SIDEWALKS AND USE OF OPEN SPACES CODE OF 2OO I CHAPTER II iect matter concerning and rclated to street aod sidewalks, use of open spaces, parking ations, and all other matters enumerated by this Code. CIIAPTER TII 3. DEFINTTION OF TERMS. As used ir this Ordinance the following terms hereby defined as follows; Open space r€fers to all open spac€s in subdivision and corrmunities withh the city designated or intended for use as communiry r,?fik, plaza, ot playground 2. Sider4aik any paved or unpaved footwalk at the side of the stleet or roadway. 3. Public Place - refers to a place use by the general public, whether privately or govemrnent owned such as park, public utility vehicle, req€ational canter, church public c€metery, street, alley, sidewalk, national road highway, cinem4 public parking are4 and public or private market gocery. 4; Major Thorougbfare - refer to stree! highway, avenue, or road that is primadly used as regular route for both public and private vehicles. 5. Secondary Roads - refer to all streets or avenues; considered as access roads wifiin the vicinity of market, shopping mart, sports or rccrcational areas. 6. Altemative Routes - rcfei to streets, roads and tloroughfare utilized as detour routgs for vehicular trafrcs. I ORDINANCE NO 126 Series of 2001 7. Used Oil - rgfers to any various geasy, combustible, liquid substances, obtained from mineral matter used in the operation of auto and industrial machinedes- 8. Youngster rcfers to person or individual who is bslow fourteen ygars of age. 9. Scoot or Scootq kind of foot-pedaled platforrL wooden or metal, about 4 feet in size with rollers and vertical handlebar. 10. lntoxicating Liquor any kind of liquor or beverages idended for use as a bevemge which contain alcohol spirit. 11. Bladed Instument refer to any kind of deadly instrument such as lnife, balisong, samuai, spear, pana, dagger , bolo, barong, kds, icepick, jabbing liza or chako and similar instruments. 12. Public Grounds - refer to all op€n arcas within the boundaries of school premises, govemment-owned building and structures, including govemment- owned lot ard abandoned lots declared plant ad plart by tlrc govemment. 13. Roads - are op€n spaces desigtated for user of motorized vehicles and commulers. 14. Parks - refer to all open spaces maintained in its mtual state as public propefy which are kep and maintained for public use, leisure and pleasure. 15. Plants refer to youtrg trees, vines, foliage, shrubs or herbs of arborescent form. 16. Trees refer to woody perennial plant having a single elongated main stem with leafr branches and with few or no branches on its lower part. 17. Nuisance - any act, omission, establishment, condition of property or anything which injures or endangerc the health and safety of otherl armoys or offeods the senses; shocks, dafies or di$egard decency and morality; hinder or impairs the use of property and obstuat or interferes witl free passage of aly public highway or sheet. 18. Public Nuisance - an atrnoFnce, trouble, danger or damage which alTects a conmunity or neighborhood or any considerable number of persons, although the extont of the annoyance, danger or damage upon individual may be unequal. 19. Private Nuisance one rryhich is not included in thc definition of public nuisance but ajfects an individual or limited number of individuals. 20. Auction Site - any area wher€ the artual bid calling is located. 21. Nanow Stre€t - refers to stree! roadway or passageway where vehicles a..e to pass having a width offour (4) meters or less. 22. I ORDINANCE NO. 126 Series of 2001 CHAPTER IV ENTORCING AND IMPLf,MENTING BODY 4. SECTION TIIE STREETS AND SIDEWAIKS OPERATION CENTER (SSOC) shall serve as an enforcing and implementing body of rhe DISIPLINA SA BANGKETA gogram of the City Govemment of Marikina. Its aim is to cleai the sidewalk of obstruction and unsightly objects. C}IAPTER V RESTRICTION ON THE USf, OF STREETS AI{D SIDEWALKS SECTION 5. Any person, natural or juridical shall b€ Fohibited to occupy any portion ofthe stests and sidewalks within the Ciry ofMarikina for purposes other than use for p€destrian walk. Specifically enurnerated herein axe Fohibited uses of streets and sidewalks. a. Vending or selling offoods, magazine, newspape$, cigarettes, broom, watches or jewelries, shoes ard other footwear. b. Conduct ofshoe- shine occupation c. Conduct ofrcligious activities, such as preaching and seeking alms. d. Doing house chores such as washing clothcs, hanging clothes and bathing. e. Vehicles garbage or vehicles repair. f. Dumping garbage. g. Setting up baskelball court and goal. h. Use ofsidewalk to install pens ofanimals or keep animals in chain. i. Sto ng softdrink oI wine, liquor botdes and cases, drinking liquor and b€verages, ard holding picnics and gatherings. j. Sloring ofjunks and recycleable materials. k. Use ofsidewalk for storage ofconsAuction materials for sales pipes, tubing, lumber and cemenl. Impounded non perishable, usable or seniceable materials and equipment be forwarded to the custody of the Office of City Treasurer.
