Pvsu^ to Afticle Xv, Section 4 ofthe Constitution of the Philippines, it is the duty of the family to take carc of its elderly memb€rs while the State may design prognrms of social s€curity for them. Furth€r, Anicle Xlt, Section I I in the Declaration of Principles and State Policies provides: "The State shall udopt dn integlated dnd cornprche^tive apprcdch to heallh development which shall endeavor lo make essenliul goods, heahh and other socidl senices available lo all the people at afonlable cost. There shall be priority fot lhe needs of the underprivileged, sick, elderly, tlisabled, *omen and chldren." Under the operative prinaiples of dec€ntralization and as provided for under the Local Govemmaoa Code of 199t, the capabilities of local government units shall be enhanced to participate actively in the implernentation ofnational programs and projects. SECTION 3.Porrciar. In consonaoce with the above Declaration of Principles, the following are the declarcd policies ofthis Code: (a) To motivatc and maximizp thc contribution of senior citizcns to nation-building and active psrticipation and involvement on the development proglams and proj€cts of the City Govcrnment of Maikina; (b) To encourage their families and the communities they live with to rcaflirm the valued Filipino culture and radition ofcaring for the elderly; odliMncc No. 0E6 Seri.r ol20t s Pa* oi of 2s (c) To recogniz€ the righl ofthe elderly and provid€ full support to their well-b€ing &nd prop up their active panicipation in social and civic activities, (d) To provide a comprehensive health care and rehabiliiation system for persons with disabilities, non-pensioner senior citizens to inspire and foster their will and capacity to attain a more meaningful productive aging: and (e) To seek the active panicipation and pannership of the private sectors, non-govemmental organizations and other people's organizations in promoting the welfarc of the senior citizgns. SECTION 4Jr,r?ase of thls Cod.. within Ma kina City, this Code shall cover and govem the implementation of Republic Act No. 7432, otherwise krown as the "Senior Citizens Act", as amended, Republic Acr No. 9257, olherwise known as the "Expanded Senior Citizens Act of 2003", and Republic Act No. 9994, otherwise known as the "Expanded Senior Citizens Act of 2010" as well as the lmplementing Rules and Regulations covering the said Acts, as promulgated and adopted by the D€partment of Social Welfare and Developmenl (DSWD). Provisions of the Senior Citizens Act, which are conc€ms of the of ihe national govemment, are incorporated in this Code for the information of concemed senior citizens of Marikina. as well as for the information of those establishments that are mandated to gnnt b€nefits and p.ivileges to the elderly. All other provisions thereof for as long as they are applicable for implementation in Marikina City shall b€ enforced by this Code. SECTION S.Detinition ol Terns- For purposes of this Code, and as defined under lmplementing Rules and Regulations (lRR) that covers Republic Acts 7432, 925'7 , afrd 9994 , the following te.ms are hereby defined as follows: (a) ACCREDITED NON-GOVERNMENT ORGANIZATION (NGO) shall refer to any private non-profit organization, regional or national in scope, mainly providing services for senior citizens, duly registered with the Securities Exchange Commission (SEC) and accredited by the Depanment of Social welfare & DevelopmeDt (DSWD); (b) BASIC NECESSITIES shall refer to canned sardines, tuna, evapoBte, condensed. and powered filled milk, coffee, bread, white and brown sugar, cooking oil, instant noodles, luncheon meat, meat loaf, comed beef, frozer/refrigerated/preserved/ready- to-cook pork, beef and ahicken, rice, com, bread, fresh./dry/canned fish and other marine prodrcts, fresh pork, beef and poultry meat, fresh eggs, fresh and processed milk, fresh vegetables, root crop6, coffee, sugar, cooking oil, salt laundry soap, detcrgenls, firewood, charcoal, candles and drugs classified as essential by the Department of Health (DOH), and other commodities as maybe classified by the Department ofTrade and Industty (DTI); (c) ACT/ ACTS shall refer to Senior Citizens Act and/or the Expanded Senior Citizens Act of 2003 and the Expanded Senior Citizens Act of20l0; citizen or not; who takes care ofhim or her is a dependent, (e) DENTAL SERVICES shall refer to oral examination' cleaning permanent and temporary filling, extractions and gum treatrnents, restoratiorL replacement or repositioning of tieth, or alteration of alveolar or periodontium process of ihe maxilla and the mandible that are necessary for the diagnosis and /or treatment of dental illness or injury; (f) DIAGNOSiIi and LABORATORY TEST shall refer to X-Rav, CT scans, blood chemistry examination' histopathology and immunopathology, hemalology' urine (Nin ne. Na CA5 analysis, parasitology and bacteriology test, serology, blood banking and other diagnosticexaminations that are necessary for the diagnosis or treatment ofan illness or injury; (g) ESTABLISHMENT shall refer to any private business entity or commercial in establishment engaged the sale of goods, commodities, foods or offering services that are duly licensed or fianchised by the national govemment or by local govemment unitl (h) GERIATRICS shall refer to thc branch ofmedical sciencc dcvotcd to the study ofthe biological and physical changes and the dis€ases ofold age; (i) HEAD ofthe FAMILY as defined in the National [ntemal Revenue Code, shall refer to an unmarried or legally separated man or woman with one or both parents, or with one or more brothers or sisters, or with one or more legitimate, recognized natuml or legally adopted children living with and d€fEndent upon him for thei{ chief support, where such brothers or sislers or children arc not more than twenty-one (21) years of age, unmarried and not gainfully employed or where such children, brothers or sisters, regardless of age are incap@ble of self-support b€cause of menta.l or physical deGctl 0) HOME HEALTH CARE SERVICE shall refer to healih or supportive care provided to the senior citizen patient at home by licensed health care professionals to include, but not limited to, physicians, nurses, midwives, physical therapist and caregvers; (k) IDENTIFICATION CARD or ID shall refer to the senior aitizen's ID issued and signed by duly constituted authorities to an elderly; (l) IDENTIFICATION DOCL,MENT shall refer to any documentary or material proofof being a senior citizen which shall be used as basis for the issuance of senior citizen identification card (lD) and for the availment ofthe benefils and privileges under the law such as, birth or baptismal certificate, Philippine passport, SSS or GSIS papers, military service record, or other authenticated document or pspers that will prove the senior citizen's age: (m)INDIGENT SENIOR CITIZEN shall refer to any elderly who is frail, sickly or with disability, and without pension or p€rmanelt source of income, compensation or financial assistanca from hisiher relatives to support his/her basic needs, as dctermined by th€ Departmenl of Social Welfare and Development (DSWD) in consultation with the Nalional Coordinaling and Monitoring Board; (n) LODGING ESTABLISHMENT shall rEfer to any building, €difice, structur€, apartment or house including tourist inn, apanelle, motorist hotel, and pension house engaged in catering, leasing or providing facilities to transients, tourists or travelers; (o) MEDICAL SERVICES shall refer to hospital services, professional services of physicians and other heahh care professionals and diagnostics and laboratory tests that are necessary for the diagnosis ot treatment ofan illness or injury, (p) NEAREST SURVIVING RELATIVE shall refer to the legal spouse who survives the deceased senior citizen. Provided, that where no spouse survives the decedent, this shall bc limited to relatives in the following order of degree of kinship: children. parents, siblings, grandparents, gardchildrcD, uncles and aunts; (q) NON-GOVERNMENTAL ORGANIZATION (NGO) shall refer to any private enrity which is non-profit and voluntary in nature dedicated to the promotion, enhancement and support of the welfare of senior citizens, duly registered with a regulatory body; G) OFfliE for SENTOR CITIZENS AFFAIRS (OSCA) shall refer lo the oflice established in cities and municipalities under the Office ofthe Mayor and headed by a senior citizen; (s) PzuME COMMODITIES shall refer to fresh fiuits, flour, dried/ procoss€d/ canned pork, beef and poultry meat, dairy products rct falling under necessities' -basic nooiles, onion, garlic, herbicides, feeds and veterinary productions fot poultry' swine-- dr.) (N;nonae No, 0E6 and catde, p6per, school supplics, nipa shingles, plyboard, construction nails, batteries, light bulbs and electrical supplies, steel wire and all drugs not classified as esscntial drugs by the Department of Health (DOH) and other commodities that may be classified by the Depenment of Trade and Industry (DTI) and the Department of Agriculturc (DA); RECREATION CENTER shall refer to a place thal offers recrcation and relaxation for a fee or for free which includes sports facility, indoor games, board games, and the likes; (u) RESIDENTIAL CARR GROUP HOME, RESIDENTIAL COMMUNITY oT RETIREMENT VILLAGE shall refer to a facility which provides t\rcnty four (24)- hour resident group carc for the physical, mental, social and spirituat well-being of senior citizens in a homelike atmosphere which is accredited by the D€partment of Social Welfare & Developmenl (DSWD) and licensed by the concerned local govemment unit wherE the said facility is situated; (v) RESTAURANT shall refer to any establishment duly licensed by the local government unit (LGU), offering to the public regular and special meals or menu, fast food, cooked food and short food orders, including te4 coffee, soft drinks and hot and cold bev€rages; (W)RETAILER, as descdbed under the DTI guidelines, shall refer to any person engaged in the business of selling consumer Foducts directly to consumers, which shall include among olhers, supermarket, grocery stores, convenience and mini- convenience stores, bake es, but excluding sari-sari stores, wet markets, 'lalipaps" alld cooperative stores; (x) SENIOR CITIZEN or ELDERLY shall refer to any resident cilizen ofthe Philippines sixty (60) years old abovel (y) SENIOR CITIZENS CENTER shall refer to the place established by Republic Act No. 7876 with recreational, educational, health and social programs and facilities designed for the firll enjoyment and benefit of the senior citizens in a city or municipality. SECTION 6Jrleaning of Abbreviations. SECTION Esenior Citizen't l.D. (I.len ificalion Card,). Every qualiEed s€nior citizen has the right to be issued with a valid Senior Citizen's l.D. which shall be the proofofhis or her being a senior citizen, aod who shall be entitled to all the rights, benefits alld privileges accorded to the elderly. The senior citizen's l.D. is not transferable and shall not b€ used for any purpose or purposes, other than what was provided by law. The loss of the I.D. shall be reported immediately to the Offrce for Senior Citizens Affairs (OSCA) for replacement ln case of death of a senior citizen, his or her Senior Citizen's LD. shall be surendered by the nearcst of kin to of- the OSCA or to the Local Civil Registry Office of Marikina who shall require the surrendering tid' Ordinorc. CHAPTER TII RESFONSIBILITIES of SENIOR CITIZENS SECTION g.Respo//,sibtltcies of Seniot Cltizen& Every senior citizen, rEgardless of his or h€r sex, religion, social slatus, creed, politiaal anlecedents and other facto.s, and for as long as h9 is capable physically and mentally, shall: (a) Maintain an upright ard virtuous life in accordance with the tenets of hivher religious beliefs and the dictates ofclean conscience: (b) Love and respect the members of hiVher family and share with them hiVher wisdom for the strengthening, unity and harmony ofthe family; (c) Exen his/her best eIIort and capability, gained potentials and suitable abilities in serving his/her fellowmen and hivh€r community; (d) Respect his/her fellowmeq their customs and traditions, the duly conslituted authority, laws ofthe country, and the principles and institutions ofdemocracy; (e) Involve himsel?hcrs€lf and particip8te actively, to the extent of hi$/her capability in city govemmenl prognms and projects, social affairs and civic activities for the promotion of public welfare, bearing in mind that their past knowledge and gained expertise will help Featly in promoling the good image ofthe city, as well as, shaping the country's future, (f) H€lp in the observance of human rights, the strengthening of freedom, the fostering of coopeftltion in the pursuit of common aspiration for prog€ss and prosperity and the furtherance of peace and order. CHAPTER IV CREATION of the OFFICE for SENIOR CmZENS AFFAIRS (OSCA) end BARANGAY OSCA SECTION l0.Crcation of the WEe lu Senior Citiun's Alltits (OSCA) of MoikitaAn Office for Senior Citizens Affairs of Marikina is hereby created. SI,CTION ll.Provisiory'Allocttion of an OlJice Space lot OSCA. The City Govemment of Madkina shall provide and allocate an office spac.e for OSCA in any City Covemment building, including the provision ofth€ necessary amenities therefor. SECTION l2fianctions of the OSCA. Thc Office for Senior Citizens Affairs of Marikina shall have rh€ following functioos and rcsponsibilities: (a) To plan, implement and monitor yearly work programs pusuant to the objectives ofthe Senior Citizens Aat (RA No, 7432), as amended by the Expanded Scnior Citizens Act of 2OO3 (RA No. 925?) and further amended by the Expanded Senior Citizens Act of20l0 (RA No 9994); . .ld Ordinonc. No. 0E6 Seri.' of 20t s Pace 08 ol2s (b) To draw up a list ofavailable professional and/ or lechnical expertise and service that can be offsred or provided by lhe senior citizens of Marikina; (c) To maintain and update regularly on a quanerly basis the record and list ofsenior citizens ofMarikina: (d) To serve as a general informalion c€nter for all senior citizens of Marikina, as well as serve as a liaison oflice lo cater to the needs ofthe Marikina elderly; (e) To monitor compliance of the p.ovisions of the Senior Citizens Act and the Expanded Senior Citizens Acts, panicula y on the grant of the special discounts and privileges to senior citizeas: (f) To repon to fie City Mayor all violations of the Senior Citizens Act and Expanded Senior Citizens Act, with a copy of such repnrt fumished to the conc€med Barangay OSCA: (g) To assist senior citizens in filing aomplaints or charges before the Department ofJustice (DOJ), provincial or city courts the violation of any person, natural or juridical, establishment, institution or agency refusing to comply with the benefits and privileges ganted under the Senior Citizens Act and Expanded Senior Citizen Acts of 2003 and 2010; (h) To assist and coodinale in all investigations regarding or relative to fraudulent practices and abuses ofthe discounts and privileges committed by any erring senior citizen; (i) To establish linkages with accredited NGOs, p€ople's organizations, other government institutions, and the barangays in their respective areas; 0) To make representation in seeking financial gmnt, aid or resources from local, foreign, or international organizations, NCOS, foundations, and other concemed institutions in pursuit of programs and projects rebounding to the b€nefit and welfare of the senior citizens or for the community; (k) Formulate and prepere the internal rules and procedures for application to the intemal affaiN ofthe OSCA; (l) To perform such others functions and responsibilities as may be required by law or duly constituted authorities. SECTION l3.Quqlwqtions of the Head ol the OSCA. A qualifted senior citizen shall be appointed by the City Mayor to head the OSCA who must possess the following qualifications: (a) The scnior citizen must be a natural-bom Filipino citizen and must havc resided in Madkins City for at least one ( I ) year: (b) The senior citizen must be a regislered voter ofMarikina City; (c) The senior citizen must be able to read and write; (d) The senior citizen must be physically and mentally fit, (e) The senior citizen must b€ a bona fide and active member ofthe OSCA. SECTION l4.Manner ol Selection and Appoinlmenr of the OSCA IIed- A general assembly of the senior citizens of Marikina shall choose and recommend thrce (3) senior citizens for consideration of the City Council of Marikina and subsequent endors€ment to the City Mayor who shall finally appoint the head ofrhe OSCA. SECTION li.Tem of Olfrce of theOSCA Head The OSCA Head ofMarikina shall have a term ofthree (:) yein wittrout reappointment but without prejudice to an extensionif ^d Ordinance tio. 0E6 ws#t: exigencyof public sewice so r€quires. In cas€ of demise or permanent disability, the remaining orunexpired term of the OSCA Head shall b€ served by the new appointee provided that he/she shall have undergone the selection process. The newly-appointed head is eligible for re- appointment provided that he or she has not served one-half( l/2) ofthe full term. SECTION l6.Operaliol and Mainrenance of the OSCA. The necessary funding for the operation and maintenance of the OSCA shall be appropriated and approved by the City Governmcnt of Marikina. Appropriations thcrefor shall bc bascd on thc approved work programs and projects aItd estimated op€Etional expenditures which are to be submitted by the OSCA. SECTION l7 Superyiston of and Asslsrance to OSCA. The omc€ of the Mayor shall exercise supervision over the OSCA relative to their plans, programs and projecb, and activiiies for the senior citizens of Marikina. The DSWD-Marikina and concemed city goremment offices or agencies shall assist the Head of the OSCA in the propcr implementation of the aforesaid plans, progams, projects, and activities. CHAPTER V CREATIOITi of BARANGAY OSCA SECTION lS.Creqlion o! Baro.ngay OSC,{. There shall be created a Barangay OSCA for each of the sixteen (16) barangays of Marikina. Each Barangay OSCA shall be composed of a Chairperson, a Vice{hairperson, a Secretary, a Treasurer, an Auditor and four (4) Board Members all of $,hom are to be elected by the senior citizens ofthe conc€rned barangay. Period oftheir election will start every l"t Saturday ofJuly prior to the end ofeach term ofoffice. SECTION lg.Qualwafion of the Chairpersoa ol Barangay OSCA. The qualifications of the Chairperson ofthe Barangay OSCA shall be the sarne as that ofthe qualifications ofthe Head of OSCA Marikina and must have resided in his or her barangay for at least one ( I ) year. SECTION 2O.Man Et o! Selection and Appointmenl o! Barungay OSCA Chairpenon" The Barangay OSCA Chairperson, Vice-Chairp€rson and olfic€rs thereof shall be elected by an assembly of senior citizens residing in th€ concemed barangay. The election guidelines and procedures shall be formulated by the Community Relations Offic€ (CRO) and the Chairp€rson of the Committee for Senior Citizens Affairs of the SangguniangPanlungsod of Marikina, in coordination with the concemed Barangay Govemment. The elected Chairperson shall automatically be a composite member ofthe OSCA ofMarikina. SECTION 2l.Iezn a/ O!fice ofthe Choirpenon.of the Earungay OSCA. Assumption of office 2' of Barargay OSCA Ollicers shall be on every Monday of Augusl- upon rheir taking of oath of office. Chairpersons of the Bar.ngay OSCA and all other olficers shall serve for one ( I ) term equivalent to three (3) years with re-election. After the 2d term of office, all oflicers are still allowed to run for any position but not in the same position he was elected on his first and second term ofoffice. In case of demise or permanent disability ofa Chairperson, the remaining If and unexpired term shall be automatically assumul by the vice{hairpcrson. the Vice- Chairperson, due to a reasonable caus€, is unable to assume the vacant post ofchairmanship' by operation law on succession, the next officer in line has lo serve the remaining and unexpired term of the Chairperson. In this rcgard, the ranking provided in Section l8 of this Ordinance shall be followed. - (Ninon . Terms of employment shall aonform to the provisions of thg Labor Code, as amended, the Civil Services rules and regulations and other laws. Private entities that shall employ senior citizens as employees upon effectivity ofthe Expanded Senior Citizens Act, shall be entitled to an additional deduction from their gross income, equivalent to Fifteen Percent (15%) of the total amount paid as salaries and wages to senior citizens, subject lo the provisions of the NIRC, as amended in the Revenue Regulations io be issued by the BIR approved by the Department of Finance (DOF). Provided, however, thal such employment shall continue for a period of, at least, six (6) months. SECTION S2.Education The DepEd, the TESDA and the CHED, in coordination wiih NGOS and POs shall institute a progmm that will ensure access of senior citizens lo fomal and non- formal education, and they are to: (a) Formulatc and implemcnt rclevant and cffcctive course designs and educational prognms; (b) Conduct the necessary taining for the implementation of the appropriate curriculum for the pupose; (c) Ensule the availability ofthe needed educational facilities and materials; (d) In coordination *ith the OSCA and the CSWDO, shall conducl nss€ssmenl and profiling ofsenior citizens who wanted to study; and (e) Conduct continuing research and development program for the necessary and relevant education ofthe senior citizens. SECTION s3.rlearrrr. The DC)H, in ctnrdination with the City Govemment of Marikina, N(;C)s and POs for senior citizens, shall inslitute a national health program and shall provide an inte$ated health service for senior citizens. The health program aims to promote healthy and productive elderly population through: (a) Establishment and provision of comprehensive and integated health service package cat€ring to the specific needs ofthe elderly, (b) Human resouce developmentl capability/building of health p€rsonnel in relation to the care and health problems ofthe elderly, (c) Health promotion for senior citizens: (d) Conduct ofres€arches and study. SECTION 54Jt ciql SeNices, The DSWD-Marikina, in coordination with the OSCA of Marikina, NGOs, conaemed POs, and concerned offices and agcncies of the City Government,shall develop and implement programs on social services for senior citizens, the component ofwhiah are: (a) Self and social enharrcemcnt services to provide wnior citi2rns opportunities for socializing, organizing, creativeness and s€lf-improvement; (b) After aare and follow-up seftices for senior citizens who are specially those who have problems of reintegration with the family and community, ftee counseling shall be provided to both the senior citizens and their families, (c) Neighborhood support services $,herein the community or family members shall provide care-giving sewices to th€ frail, sick or bedridden senior citizens; (d) Substitute family care in the form of residential care-group homes for the abandoned, neglected, unattached or homeless senior citizens and those incapable ofself-care; and (e) Inclusion of community-bas€d settings as practicum for academic institutions and in the curriculum of care-giving and technical vocational schools SECTION S5Jlousitg. The Senior Citizens Act, as expanded and further amended, provides that the national govemment shall include in ils national shelter program the special housing needs ofsenior citizens, such as establishment ofhousing units for the elderly. The HLURB is mandatcd to formulatc housing designs suitable to the requirements and needs of the senior citizens. In accordance with Executive Order No. 105, promulgated on May 16,2002, the housing program shall include the establishment and/or donation of group/foster homes for the neglecte4 abused and unattach€d or homeless senior citizens and those incapable of self- care, including its management, maintenance and operation- SECTION 56/cc.fss lo Ptblic Tradsport The DOTC in coordination with concemed agencies is mandated by the Acts to develop programs lo assist senior cilizens in gaining full access in the use of public ranspon and facilities. The minimum rcquirements and standards to make transportation facilities and utilities for public use shall be developed for ac.ccssibility and mobility ofsenior citizens, particularly those with disability, pursuant to the Accessibility Law. With the financial aid ftom the World Health Organization (WHO), the S€nior Citizens Health Lifestyle Center is a venue for social and recreational services, sports and other socio-cultulal activities and on where senior citizens can avail fte€ medical services' obtain health counseling, and other health sewices. NGOS and/or private volunteer organizations, dadicated to the Fomotion, enhancement and suppon of the welfarc of senior citizens are herby encouraged to become partners ofthe govemment in the implementation of programs and proJects for the elderly. The govemment shall recognize the vital role of NGOs in complementing the govemment in the delivery of services to senior citizens. It shall likewise gncouage NCOS for senior citizens to develop innovative sewice models and pilot projects and to assist in the duplication of successful examples ofthese models elsePtrcre in the country. SECTION 63Sappon fot No,t-Gownrrcntal Oryanizations. NGOs for senror citizens may avail ofthe following from appropriate govemment agencies, subject to ceflain conditions: (a) Tcchnical &ssistance in the areas ofcapability building, packaging of proje€t proposals, provision of program materials, e.g. manuals, brochures, leaflsts, modular pockages and acting as resource persons to llaining aclrvitres. (b) Assistance to the replication of succ€ssful programs and projects; (c) Eligibility to purchase or subcontracl projeds and/or services from concemed govemment agency subject to government regulation; (d) Subsidy for program implementation depending on availability of funds and fulfillment of requirements of agency concerned, (e) Assistance in establishing linkages with local, national and intemational organizations and networks for resourca development, sharing and generation; (0 Endorsement of reprcsentation to advisory boards, sectoral councils, int€r-agency committees, lechnical working groups, among others; (g) Endorsament by the appropriate govemment agency for duty-free importation of and equipment to govemment regulations. At least Fifty Percent (50%) discouDt for the consumption of electricity, water, and telephones shall be ganted to the senior citizens center and residenlial carelgroup homes that are non-stock. non-profit domestic corporation organized and operated exclusively for the pupose ofptomoting the well-being ofabandoned, neglected, unattached, or homeless senior citizens. To avail ofthe discounts, the' following are required; (a) Accredited Senior Citizens Center i. Being utilized by the senior citizens as certified by the DSWD Regional Oflice ii. SECTION 6'rlssistance to Resden ial Home{Commanitie$/Retirenvnt ,4lrageslndividuals or accredited non-govemrnental institutions establishing homes, residential communities or retircment villages solely for the senior citizens shall be accorded the following: (a) Realty tax holiday for the fint five (5) yeals starting ftom the first year of opention subject to the guidelines to be issued by the DOF and its Bureau of Local Gavel Finance. (b) Pdority in the building and/or maintenanc€ of provincial or municipal rcads leading to the aforesaid home, residential community or retirement village. CIIAPTER XV MONITORING rtrd C(X)RDINATING Mf,CHA|IISM SECTION $.Moniloring and Coo.dinating Mechanisnl The Expanded Senior Citizens of 2003 mandsted the establishment of a national inter-agency coordinating and monito ng mechanism at the nationai level known as the, "National Inter-Agency Coordinating & Monitoring Board", prescribing its composition and defining its functions. The Act also required the establishment of an Inter-Agency Coordinating and Monitoring Board at the regional level with the same functions with the same membership and similar functions that ofNational Board. Pusuant lo the devolved functions accorded by the Govemment Code of l99l to local governmcnt units, the City Govemment of Marikina hereby establish ils Local Inter-Agency Coordinating & Monitoring Board. (g) Coordinate the conduct aDd evaluate of plan ofaction, research, and documentation of goods participates and dispariries for policy and progam development. CEAPTER X!'I IMPLEMENIING MECIIANISM AND f, NFORCING AUTHORITIES SECTION TlJnplernenti,tg MechanismTo help ensure cffectivc implementatiorl of thc Senior Citizens Act and the Expanded Senior Citizens Aat, the following offices and agencies of the City Govemment shall: (a) The Offic€ for the Senior Citizens Affairs (OSCA) of Marikina shall exercise all the mandated functions and responsibilities as provided for under the Senior Citizens Acts. (b) The Business Permit & Licensing Office (BPLO) of Marikina shall, prior to the approval and issuance of business permits and licenses, furnish to the establishment copies ofthe peninent Fovisions of Republic Act No. 7432 (Senior Citizens Act, as amended) and Republic Act No. 9257 (Expanded Senior Citizens Act of200l ). (c) The Public Information Offic€ (PTO) of Marikina shall launch a city-wide information campaign regarding the aforementioned Senior Citizens Acts. (d) The City Transportation Management & Development OIfice (CTMDO), prior to approval and issuance of franchise to operate, or renewal thereof , shall require all public utility tricycles opeEting within Ma.ikina City to post the requircd slicker that reflects the 2070 discount to be granted to senior citizens. (e) The Barangays of Marikina shall disseminate information regarding the pertinent provisions of the Senior Citizens Act in their r€spective areas of jurisdiction, including thc posting ofthis Code in the bulletin boards in their barargay halls. (f) All concemed offices and agencies of the City Govemmcnt shall b€ furnished with copies oflhis Code for their information, guidance and dissemination. SECTION TzEnlorcing Aarhotitier, All agencies of the City Government of Marikina vested with police pow€rs shall be responsible for the strict implementation and enforc€ment of this Code, to include: (a) The Barangay Captain and /or the Committee on Senior Citizens Affairs of the barangay. (b) The MarikiD PNP and other law-€nforcing agencies ofihe City Govemment i .Cr S?,ics of 20t s Pas. 23 825 CHAPTER XVII APPLICATION of PENALTIES SECTION T3Jeaalrier for Persons. Any person who violates any provision of the Acts shall be imposed with the following penalties, as prescribed under the adopted implementing Rules ard Regulations covering the Senior Citizens Acts. (a) For the first violation, a fine of not lcss than Fifty Thousand Pesos (P50,000.00) but not exce€ding One Hundrcd Thousand Pesos (100,000.00) and imprisonmenl for nol less than two (2) years but not more than six (6) years; (b) For any subsequent violation, a fine of not less than One Hundred Thousand Pesos (P100,000.00), but not exceeding Two Hundred Thousand Pesos (P200,000.00) and imprisonment for nol lcss than two (2) years, but not more than six (6) years. (c) For abuse of the privileges $anted under the Acts, a fine of not less than Fifty Thousand Pesos (P50,000.00), but not more than One Hundred Thousand Pesos (P100,000.00) and impdsonment ofnot less than six (6) months. (d) If the offender is an alien or a foreigner, he shall be defrorted immediately after s€rvice of s€ntenc€ without funher deportation proceedings. Pursuant lo the devolved powers and authority vested upon local govemment units by the Local Govemment Code of l9l, the fines and penalties imposed by the City Govemment of Marikina for violation of City Ordinances shall b€ separate and exclusive of the fines and penalties imposed by the Senior Citizens Act, unless otherwise declarEd by the judicial court or competent authority.
