12. ENERCY TFFICIENT LIGETING SYSTEM (EELS) - rcfers to lighting rvith a
lower wattag€ used by consumers and traders in their businesses.
13. EARBORING - refers to atr act whereby a person gives sbelter, aid and protection to
illegal vcndors.
14. EOARDING - refers to the unduo accumulation by a person or combination of person
of any prime commodity beyond his or their normal inventory levels or consumption
by uDreasonably limiting or refusing to dispose of, sell to the general public. It may
also mean the unjustified taking out of any basic necessity or prime commodity from
the channels ofproduction, trade, comrnerce and industry.
15.IMPERVIOUS MATERIALS refers to hardware materials that are impeneaable,
not capable ofbeing damaged and tamished, not alfect€d by harsh elements of natwe,
such as mildeu dgae, nlngr, or moish[e, with plain and smooth surface that are
durable and resistant to wear and corrosion. Samples of imper'vious materials are
stainless steel plates, ceramic tiles formica sheets, porcelain plates, marble slabs, and
other smooth surface, non-porous, and rryatq or moist rcsistant materials.
16. INTOXICATING LIQUOR - refen to any liquor intended for use as a beverage or
capable ofbeing used, which contains alcohol, no matter how obtained, in such percent
as il will produce intoxicatiol

not limited to tables, chairs, and benches.
19. LESSEE - refers to a persoD, natural or juridical, who rents and/or occufes a

clustered in accordance with the kind ofmerchandise offered for sale:
a) Ffuh/S€tfood Sectior - is the area where all fresh fish, seafood and marine
products arc sold.
b) M€at Sectiotr - is the area where all kinds of meat and other meat products
that passed the inspection of our City Vetednary Offic€ in accordance with
the standards set by the Netional Meat lnspection Commission are sold.
c) Dry Goods Section - is the ar€ where all kinds of textiles, modisVtailors
supplies and sewices, accessories, apparels, native products, toiletries,
novelties, toys, footwear, kitchenwares, and other household articles,
handbags and oIfice supplies are sold.
d) Special Stslh - is the area where establishments such as: reslaurant,
paunshop, hardware, drugs store and beauty parlor, internet cafd, flower
shop, gift shop, magazineVnews stand, bayad center, amusements and

e) Grocefi€s S€ction - is the area where all kinds of bakery, clairy, cold cuts,

SIIPERI'ISION AND CONTROL
SECTION 5. CITY MAYOR - the City Mayor shall exercise direct and immediale
supervision, administration and control over the public market and the personnel thereof,
including those duties conceming the maintenanc€, upkeep, peace ani ords ofthe market
premises- in accoldance with lars, local ordinaaces and other rules and/or regulations
pertinent thercto.
SECTION 6. CITY MARKET ADMINISTRATOR thore shall be a Market
Adminisfator who shell b€ under the dircct supervision and contol ofthe Mayor'
1. To implement and execute the plans and policies ofthe City Mayor in the operation
of all government owned/operated public m&*ets and to implement Government
Regulitions in private ma*ets, tatipapas/satellite markets pertaining to sanitation,
cleinliness, security, safety, order and d€porhn€nt inside the market premis€s.
2. Secue periodic collection rcports ftom the City Treasur€r to include comparative
statemcnts of collection ofmarket revenues.
3. Gather and provide statistical data on prevailing prices of goods in the public
market for other agencies.
4. Supervise, evaluate, and administcr ma*et property including acquisition,
utilization, maintenance, looses and disposal thereof
5. To exercise adminisf&tive authority over the Market throughout the City of
Marikina.
6. To monitor, ovenee and implement policies on avoidance of dec€ptive practices,
under weighing, harboring and hoarding to include all mafiers relative to proper
garbagn and waste disposai;

such other frrnctions as may be required by la*s or ordinances.
SECTION 7. MARKET MASTER - There shall be orc Maxket Master for each
gov€mment-owned and/or operated public ma*et. He shall be the custodian ofthe market
and shall have immediat€ administrative supervision and control oyor all subordinate
market personnel thercio.

aftitudes.
4. Manage the maintenanc€ and efficient utilization of all ma*et gopefiies

supplies.
5. Perfom such other fiuctions and duties that may be assigned to him by the City
Market Adminishator.
SECTION 8. MARKET SUPERVISOR - there shall be a Market Supervisor who shall
be under the diroct supervisiotr and control ofthe Ma*et Administrator.

Inspector,Enforcer who shall report daily to the City Market SupervisorA,farket Master for
instruction of his assigned work and submission ofreports.

STCTION 10. OTmR MARKET PERSOITTNEL - Oth€r markct personnel as may be
deemed necessary shall be appointed in apcordance with the existing civil service rules and
regulatioqs.
SECTION 1 1. CONSUMER WELFARE DESK (CWD) - the Consumer Welfare Desk
(CwD) shall entertain written, walk-in or phoned-in complaints and inquiries by the
oonsum€rs against deceptive practices such as undd weighing, hoarding and short selling
by market v€trdors or stall owners. The office of the consumer welfare desk (CWD) shall
rccord the following:
a. Name of Complainant, address and such other personal circumstances
b. Name ofRespondent addrcss and such other personal circumstances
c. Nature ofthe Complaint
d. Faots ofthe Complaint
e. Evidence presented (objects, documents or statements of witnesses)
f. Requested action on the complaint.

Marikina are required to ha e a Maxket ldetrtification Card (Ordinanoe No. 87, Series of

market, private narkets and talipapa/satellite markes shall be re4uired to secure clearance
from the Oflice ofthe City Market, as a requisite to the granting of application for new and

SECTION 14. Alt food eateries (carinderia) owners and helpers in public markets, market
zone, private markets and fl€a/satellitc markets, are requircd to undergo Food Safety and
Personal Hygiene Truining.
SECTION 15, The City Govemmert of Marikina rcquires the Posting of th€ '?ahintulot

SECTION 16. Requiring atl pubtic markets and privatc, satellit€,/flea markets

SACTION 30. WDIGFTS AIID MEASURES,
a. The use of uuderweight scales or the placing of any metal, Sadget or concealed

other than true wpight of any goods or merchandise, is prohibited.
b. All weights, measues and similax devices used by any person engaged in trade
and commerce, involving goods and other commodities the value of which shall
be determined by weight or measure and sball be registsr€d wilh the City
Treasury, pdor to the use of such devicas.
c. All weights, measures and similar devices already registered under the
pmvisions ofthis Code shall be submitted to the City Treasury for re-inspection

CHAPTER VII
- RESTRICTIONS ON PIIBLIC MARXET STALLS

SECTION 35. Limitttions. A stallholder shall not be allowed to occupy stall or space
other than those leased to him, and it sha be the duty of the Ma*et Administetor or his
authorized reFesentative to see to it that the stallholders do not octupy stalls or spaces
other than that awarded to him.
SECTION 36. Loiees of Sttllholdsrt The City shalt not be responsible for any loss or

maieri.e. Lny merchandise, goods, wares or commodities left in the city market after
closule time shall be at the risk ofthe stallholden.
It shall be the duty of tho Ma*et Adminiskator to ex€rcise utmost vigilanoe ard care to
prevent any loss in the aity ma*et and for this purpose, the Mark€t Administrator and his
iuly authorized market penonnel representatives shall have authority to apprehend and
tum over to the police any p€rson or pe$ons caught committiog any olTense in the City
Ma*et.
sECfioN 37. Abandon€d strlvArticles. Any stallbooth which have been closed for a

SECTION 39. Ej€ct€d stsllholder disquNlified to apply for a new ltdt for one (1)
year. Should the stallholder be ejected Aom hiyher stall/boo1L for cause, as provided in
this Ordinance, he/she shall be disqualified for a period of one (l) year for applying for a
new stall.
SECTION 40. UNettled water aDd electric bill ofr ltsllholder.

Each statement ofaccount for monthly water and electric bill shall be served to
the stallholder every twenty fifth (25b) day ofthe month.
b.
Non-payment by stallholder of his water and electric bilt for any given period
set forth urder Section 4 (a) shall vest authority in the City Govemment,
tkough the Offic€ of the Market Adminishator to disconnect and cut-olf the
watdr or electrical line ofthe stall of suoh delinquent payer.
ln no case shall the City Government or any of its employees be held to answer for any
damages resulting frorn any disconnection effected pu$uant to lhis Odinance.
c.
Upon full pa],ment of his arrears, the delinquent stallholder shall be issued the
necessary certification by the City Treasurer's Office which maybe then used to
apply with the OIfice of the Market Administrator for reconnection ofhis water
or electric line. A recornection fee of Two Hundred Pesos (P200.00) shall be
charged the stallholder, poyable to the City Tr€asury Office, Only upon
presentation of the offrcial rcc€ipt evidencing payment of the prescrib€d fee,
recormection of the lvaler and electdcal line shalt be effected by the Office of
the Ma*et Adminisaator. (Ord. No. 183, Seri€s of 1998.)
SECTION 41. UNettled motrthly fixed strll reotal ofstallholder&

b. In case of non-peyment of his/her delinquencies and abandoned stall for three
(3) consecutive months shall be subject for forfeiture and may dernand for
payment and constrained to rescind the contract and rcpossess stall without
prejudice to the filing of an appropdate action ag&inst the delinquent stalthotder
in order to trotect the interest ofthe City.
RESTRICTIONS FOR MARKET PREMISES
SECTION 42. P€ddlitrg ard Eawking. No person shall p€ddle, hawk, sell or ofer for
sale, or expose for sale any adicle in the passageu,ays or aisles used by purchasers in the
city ma*€t.
To avoid unjust competition, peddlers or hawken shatl not be p€rmitted to ofer for sale, in
the city market and their surroundings within a radius of200 meters where goods are sotd
or exposed for sale in the stalls or booth ofsaid markets. Neither shall they be p€mitted to
expose or sale merchandise on sidewalks, courts (patios) or place designated and/or
intended for passage of the public to the city market shall exercise strict vigitance on this
matter and enjoin strict compliance with these provisioDsdi
business in or about tlle city market shall idly sit, lounge, walk or lie in or about the
premises of the same, nor shall any person beg or solicit alms or contributions of ary kind
ill the ciry market. No person shall snnoy or obshucl market employees in the discharge of
their duties, nor shall parents allow their children to play in or around the stallVbooths in
the market prcmises.
SECTION 44. Intoxicrtin& Dispetrsirg and Serving of Liquor. No person shall drinl
serve, or dispense liquor or atly intoxicating drinks within the premises oftho city maxket.
Any violation hereof, shall subject the offerdcr to tho penal Fovisions of this Codc or his
or her award shall at once bc reyoked.
SECTION 45. Irose animals. No dogs or other animals shall be left astray in the city
market zone. The Market Admirdstratq or his authorized rcpresentatiye is hereby
empowered to catch such stlay animals and impouud them.
SECTION 46. Prohibitions.
The peddling or sale outside the public market site or premises of food stuffs,
such as vegetables, meat, fish and other perishable natue which easily
daeriorate is hereby prohibited.
b. In no caso shall anyone, stallhotder/s or outsidcrs convert the stalVbooth or
stalls,&ooths or any portior of the market premises into rempomry and
permanert dwelling where they eat, sleep and use the public toilets/baths as
their own. Any violation of this speci{ic provision shall subject the violators
thereof to the penal provisiirns of Chaptd D( Section 76, in addition to
summary ejection ftom the market Femises if the violator is a stallholder and
the stall,booths shall be considered vacant and awarded to deserving applicants
conformably with the Ordinanc€.
SECTION 47. Use ofA[€y!, Corridors 8trd Walkwlys.
a
The placing of chicken coops, chopping/cutting tables, aaimal carcasses,
display hangers, grinders, and dressed chickens and similar paraphernalia's and
products as well as dry goods and olhq articles of comrnerce on pass&geways,
alleys, corridon and walkways ofprivate markets throughout the city is hereby
Fohibitad.
Coconut products shall be siored stricdy within the confines of stalls directing
selling the same and, onc€ extracied, its shelts shall be dispensed by placing in
garbage bags.
b.
Chicken coops, chopping/cutting tables, meat hnngcrs shall only be allowed
within stalls with chicken coops and meat box to be placed Fefembly
undemeath said stalls.
c. Exemptior. The use of corridors, alleys and walkways during Saturday and
Sundays for poultry drcssing is exempted from this prohibition on Saturdsys
and Sundays.
SECTION 48, Pmhibition to buy goods from sid€wrlkr vendors. Any person is stricdy
prohibited from buying goods ftom a sidewalk verdor.
SECTION 49. Prohibition of s certaiD inadequat€ attire i! the markel All vendors

and sewage and adequate opedngs.
SECTION 51. INSTALLATION SEPTIC TANK - Ownervop€rato$ of wet markots in
the Marikina Public Market Zone and other barangays within the City of Marikina are
hercby requircd to install septic tank or acceptable waste disposal system.
SECTION 52. Tratrsport and Sale of All Types of Sh€lllish, The transport and sale of
all types of shellfish in all public and private ma*ets, talipapas and other ma*eting outlets
*{rich have been declared of red tide oontamination withia the City of Marikina is strictly
prohibited.
To enlunc€ public safety and protect consume$, the banned sheltfish shall
be confiscated and shall be destrcyed or disposed in a manner prescribed by
the Deparbnent ofHealth (DOH) or D€putnent ofAg culturc.
The transport ard sale of some shellfish shall only be allowed if and when
the Departnent of Health @Og and the Deparhnent of Agricutture has
declared said shellfish are no longer infected rvith red tide toxin and safe to
eat, and at which time, the ban as conternplated in this Ordinance shalt be
iemporuily lifted: Provided, however, that tlis Ordinance will be in full
force and elfect should cancerned natioml agencies, once again declare the
shellfish to be poisonous and unsafe to be eatetr.
SECTION 53. R€striction for the use of streets ,nd sidewalks / public places.
Conducting any activities (such as selling of any kinds /illegat v;nding,
obstructioD/encroachment of any kind) by any person is prohibited at tho stre€ts and
sidewalks/public places within the vicinity of the public market zone, private markets and
satellite ma*ets \Mithin the City of Marikina. Use of sidewalk and steets on I tompora:y
basis and for a definite period only shall secure a special permit from the Marihna publii
Market and,/or Barangay Office.
SECTION 54. firrboring or Acceptitrg Illegsl Vetrdors. The act of harboring streets
and sidewalk vendors in the City of Marikina is hercby declared illegal and strictly
prohibited.
SECTION 55, Bhd€d lNtruments.
Carrying by any market vendor of any bladed instument outside the premises
of the slaughterhouse or outside his place of work or vending area in any public
or private market is hereby prohibited.
b. The utilization of butchen krdves, cutting knives, and blad€d instuments, when
not io use, shall be kept in wooden or steel boxes and/or access of the
stallholder/user. Said boxeVcontainers shall alwavs be locked when the
insfument is not in use. ,.

c. If, for compelling reasons, these bladed instrumonts need to be transferred from
one stall anothff or ftom one slaughter house to another, the same shall be
caried with appropriate non-see thrcugh coverings.
d. This provisions shatl not apply to those persons or entities engaged in the
selling of utensils and kitchcn wares where the selling of kitchen items like
knives, cutting blades and similar items must be displayed as a mstter of
commercial practice.
SECTION 56, Liv€stock rrd Poultry Products. The injection of water and application
of coloring agents to livestock and poultry products is stricdy prohibited.
SECTION 57. Mobil€ Vending Busire$. Selling and vending of mobile stores within
the market premises is strictly prohibited. (Ordinance 04, Sed€s 201I ).
SECTION 5& Wooden Furriture. The use of wooden furnitue for any purpose within
the .l €t section ofthe Madkina Public Market and Market Zone is prohibited. All crates,
boxes or any wooden container" should be supported on pallets or stand and should have a
clearance of at least six (6) inohes from the floor.
SECTION 59, Tricycl€ Ban. Entedng of all private and public utility tricycl€s in th€
Marikina Public Markets Zorc bounding P. Paz St., Shoe Avenue, W Paz St., and lvl
Cruz St., is stricdy prohibited.
SECTION 60. R€guhtion of Porter (OrdinNnce 117 S. 2lD7). To stendardize the
ogemtion of "kargadores " or porters in the Marikina Public Market zone.

fee of scventy five (P75.00) shall be charged to include the issuanc€ of

CHAPTER VlN
The following provisions for the maintenance of market premises shall be carcfully and
sriclly observed:
STCTION 66. Clea og of Mark€t Premises. The Market Administrator or Private
Market OperatorvAdminsiators shalt s€e to it that the ma*et is always clean and in
exoellent sanitary conditions, including the aisles, division, stalls, floors, rnlls and
equipment as well as the whole tract of land belonging to the market. The cleaning ofthe
market premises should be done before the buyers start coming into ma*et. The market
building ard grounds should at all times be kept from garbage and rubbish.
SECTION 67. Public Toilets 8rd Washing FacilitieE. Every market shall be proyided
with a pubtic toilet with two compartrents, one for men and another for women, and shall
b€ kept at all times in excellent and sanitary condition. Toilet as well as the nec€ssary and
adequate washing facilities must be located near the market to enablc customers to clean
up.
SECTION 68. General Lighting frciliti$. Adequate general lighting facilities shall be
provided in the ma*ets. However, stallholders shall provide their o}!n light in their
respective stalls at their own expenses subject tro existing regulations.
SECTION 69. Glrbrge Rec€ptrcl€s, All markets shall be provided with recepacles of
the fly and rat Fooftwe for the collection ofgaxb&ge alld rubbish. These receptacles shall
be placed in the most conspicuous and convenient places in the ma*et. Individual
stallholders shall provide themselves with their own receptacles in order to avoid litt€ring
in thcir F€rnises. Garbage for disposal shall be kep inside the premises and shall onty be
brought outside sealed and tied and properly placed in sacks or bags upon collection by the
waste/garbage haulers. In case garbage could not be cotl€cted, it should be broight inside
to await for callection. The garbage receptacles shatl be in the fom of plastic bags. No
stallholder/s or other persons shall place refuse or the floor, sXalVs or any place other than
the garbage rcc€ptacles.

foods shall be sold from stalls, booths, tables or fixtures rnade ofor constructed according
to plans or designs approved by the City Engineer and City Health Officer. A1l fixhres
should be scrubbed nightly and theh surfaces kept smooth always so that food or particles
thereof will not lodge in cracks or in rough places to decompose.
SECfiON 72. Us€ of Impervious Maierials. The use of impervious materisls on stall
stables, display counte$, waus, p&rtitions and floorings of stalls for meat, fish, fiuit, and
cooked food sections in all public and private markets, mini markets and "talipapas" is
Fescrib€d by the City Govemment of Marikina.
SECTION 73, Clerning of Stalls/Booth/Spaces rt th€ €nd of the Bwitress Day. At the
close of each day's business and before leaving stallholders and tansient vendo$ shall
clean their stalvs, bootb/s, space/s. They shall also remove all dtuty matedals and place
rubbish and garbage in coniainen placed for the purpose in the market.
SECTION 74. Abtndonment of Perirhable coods. Leaving of discarded or unsold
highly perishable goods, such as meat, fish arrd other sea foods in the stalls or in any place
within the market prernises shall be unlar{rl and I'crson found to have abandoned such
goods in or about the stalls shall be liable under the penal provisions of this code without
prejudic€ to the revocation of lease ofthe person who is stallholder.
SECTION ?5. Posting of Rul€s atrd Reguhtions. The Market Administrator shal post
in each Market the rules and regulations in English or Filipino conceming the sanitation
aad good order ofthe City Markel, the mannel of leasing of stalls therein, the privilege and
obligatio.s of statlholders, and such other rules and regulations as he deem necessary in
the opemtiol and maintenance ofthe publio marka. He shall also fumish such stallholders
with a copy, in English or Filipino, ofthe rules and regulation mentioncd therein.
SECITON 76. Posting of Price Monitorhg Board. The Ma*et Administaror ad/or
Market Owner/Op€mtor shall post in each ma*et price monitoring board with the updatcd
prices of basic commodities.
CHAPIER rX
PENAL PRO!'ISIONS
SECTION 77. Surcharges - Any penon occuping or using a space in the public market
without first paying the fe€s herein-above provided, shall be subject to the peyment ofthe
market fees in an amount equivalent to t]lree times the regular fixed late for the space
occupied. Any person occupying more space than what is duly leased to him shall pay
double the regular rate for such as exta spape and any person who fails to pay the monthly
mte within the time fixed herein shall pay a penalty oftwenty-five p€r centum (25%) ofthe
late due.
SECTION 78. Opporing, Resilting, Irterfering with Msrket
INpector/Etrforc€r/Oflic€B - It shall be unlawfirl for any person to oppose, resist or
otherwise interfcre with the Market Ofticer or any of his authorized deputies in the
performancc o{ his duties. Any penon opposing resisting or otherwise interfering with a
Msrket Officer of any of his authorizcd deputies shall be penalized with a fine of Two
Thousand Pesos @2,000.00) and./or recommend the revocation ofthe bu$iness licetrse-

Any violation of this Ordinance shatl be penalized with a fine of not mor€ than
PI,000.00 or imprisonment of not more than six (6) months or both upon the discrction of
the Court.
Ifthe violation is committee by a juridioal entity, the Plesident or person-in-charge

Canccllation of Lease fught and Eje{tnent - Likewise, any stallhotder, his helper
or this duly designat€d representative who habitually fails to pay the monthly or daily fees
herein prescribed or such other regulatory fees mandat€d by othq laws or ordinances, or
violates any provisions of the Code shall be sufficient cause for the rcvocation of his right
and his ejerhnent from the stalltooih or space so occupied. The revocation or cancellation
of such lease right maybe effecled by the City Mayq upon recommendation of the City
lvlarkot Administator after observanc.e ofdue process.

any provision of this Code and who has no capacity to pay the fine, provided that the
violator is physically and mentally fit to render such seryice, lf the violator is a juridical
person, the owner(s/ manage{s),/ adminishator(s) shall render the community service., of
four (4) hours for every Php100.00 - 500.00 fine and eight (8) hous for every
Php1.000.00 and above fine.
The following ale the community services, which may be imposed upon violator:
a, Cleaning of sidernlks, stroets, pubtic building, stuctwes and suroundings.
b. And other tasks that maybe assigned by the impl€menting agencies which are
of similar nature.
C. Provision ofthis Code which arc not covered by the above-mentioned penalty shall be
govemed by the following penalty:
For violation ofchapter trI, Section 12, a fine ofone Hundred Pesos (P100.00)

be imposed shall be as follows:

all cases of apprehension, the tamp€red scale shall be conliscated and impounded then
shall bo tuned over to the City Treasurer's Oflice. The CiE Treaswer shall ensure that the
confiscated device is release to the owner, only. when the defective device has been
corre€ted and rcleased and the corresponding penalties and or/fees have been paid.
If after period of Twenty One (21) calendar days, the confiscated weighirg scale is not
redeemed by its owner, said scale shall be destroyed completely.
For violation of Chapter VII, Section 40, a recormection fee of TWO
HIJNDRED PESOS (P200.00) shall be charged the statt holder, poldle to rhe
City Treasurer's Office. Only upon presentation of the offrcial receipt
evidencing palment of th€ prescribed fe€, the reconnection of the water or
electrical line shall be effected by the ofrice ofthe Market Adminisfator.
For violation of Chaper VII, Section 48, for the first offease, a fine of Five
Hundrcd Pesos (P500.00) and for the second ofense cancellatiotr of permit and
closure of the estabtshmenl. These sanctions shall be in addition to the
penalties imposed in the aforesaid Code and/or ofthis Cod€ upon the discretion
ofthe cowt.

For non-payment of outstanding duevaccounts by stallholdeis who abandoned
the said outstanding obligations within the period of one (l) year, City Market
Administrator through the City Legal Oftice is hereby authorized to file the
necessary and appropriate action in th€ court
C}IAPTER X
FINAL PRO\ISIONS
SECTION 80. IMPLf,MrNTING AUTEORITY. The City Market Oflice is hercby
mandatod and tasked as the lead agency to implement and enforc€ this Codo. For this
pupose it may enlist the support and cooperation of the City Legal Ofiice, the operatives
of the City Health Olfice (CIIO), Office of Public Safety & Security (OPSS), the City
Envircnment Manag€m€nt OIfice (CEMO), City Transportation Management and
Development Office (CTMDO), Engineeri4 Offrce, Business Permits & Licersing Office
(BPLO) and such other govemment agencies, as it may deem necessary
SECTION 81. SEPARABILITY CLAUSE, If for any reason, any part or provision of
this Code shall be held to be unconstitutional or invslid, other parts or provisions hereof
which are not affected hereby shall continue to be in fi.rll force and effect.
SECTION 82. REPEALING CLAUSE. All ordinances and adminis&ative regulations,
which arc inconsistent with any provision of this Ordinance ar€ hcreby repealed or
modified accordingly.
SECTION 83. ErFECTMrY. This Ordinance shal take effect immediat€ly u[nn its
approld.
