Financially Distressed Estrblishmetrts - all establishments that have conducted opemtions in the City of Marikina in a period of one (1) year or more, whether a single Foprietorship, lnrhelship or a corporation, engaged in the production and manufactue of goods, consumer products, machineries and equipment, whose initial or curent capital investrnent is not less than One Mllion Pesos (P1,000,000.00), which reasons of some adverse economic conditions, such as calamities, substantial decrease ofmarkel demald for their products, poor gains and profits and for such other causes out of and beyond their control, have caused and brought them into great financial losses. 10, trood Dstablishmert - any establishment offering or sewiag food and,/or beverag€s to the public. Gasoline Saation - a place where motor vehicles is intended for re-fuel, repairs and rcconditioned such as car washing change oil, wheel balancing and alignment, tune-up, over-hauling and the like. 13. f,arboring - ao act whereby a person gives shelter and aid to an iltegal vendor, or to clandestinely shelter, succor and implopedy plotect illegal reconditioned machines, equiprnents, mechanical contrivances, instruments, appliances or appantus which may or may Dot be attache4 permanently or t€mpoErily, to the real propeny, and which are direclly procupd or acquired thru purchase from foreign or local commercial dealers. 15. Stall - an open comparhrent of area designated fol the sale or display of commodities or foodshrffs. 16. Talipapa - markets usually formd in communities, duly licensed by the City GoYemment to operate as a maxket. 17. Used Oil - any various of greasy, combustible, liquid substances, obtained from mineral irater used in the operation of auto and industriat machineries. The term shall also include lubricants, petroleum, and substance of similar character CTIAPTER II PERMITS/LICENSES SICTION 4. No business, industrial atd commercial establisbments shall operate without securing business pemitJ and/or liaeDse ftom the City Govemrnent of Marikina- SECIION 5. Natural or juridical, including single proprietorships, fiIms, associations, corporations, partnerships, and any otier establishments or entides, who engage in the business of buying and/or selling or otherwise dealing in used or second- hand articles ofvalue are hereby required and mandated to secwe evidence ofownenhip or capacity to sel1 from their dealers, suppliers, whole sellers, or any other sorrce of goods, whether natural or juridical p€rsons, prior to any purchase ol sales tramactions. This mandatory requiremcnt shall cover all pawnshops, surplus stores, junk shops, baratillos and flea markets, and all other similar business establishments or entities ongaged in the buying and selling of second-hand or used articles of ralues (Ord No. 239, Sed€s of1998) Sf,CTION 49. Only of the following evidences of ownership or capacity to sell shall be a.) Deed of sale in the name ofthe seller, dealer, supplier, or other source. b.) Official rcaeipt evidencing purchase ofthe subject article, regardless in whose narne it is made out to. c.) Purchase slip, puchase ordeq delivery receipt, sales invoice in tlle ltame of the seller, dealer, supplier, or other souc€. d.) Duly notadzed Special Power of Attomey executed by the own€r identifying thc item(s) for sale. e.) Declaration ofovrnership or capacity to sell. SICTION 50. Each affected individual or estabtishment shall keep a record book of its puchase/acquisition transactions clearly indicating the sowces of such ptrchasevacquisitions and the evidence of the ownenhip prescn&d, as indicated in section hereof Non-inclusion of any transaction in the official record book shall be prima facie evidence ofthe crime offencing. SICTION 51. Tho record book required to be kept by eaah individual or establishment mgaged in the business of buying aad/or selling articles of value must bear the omcial sbnp of examination by the City's Business Pemits and License OIfice every renewal &t€ ofthe individual's or estab[sbmcnt's business permiVlicense. SDCTION 52. Articles of value shall include pieces of jewelry omaments, filrritwes rd fixtues, appliances (mechanized or electrical), work of arts and designs, and other uticles of a similar nature and of value. ON 53. All establishments and individuals covered by this Ordinance (Ord. No Series of 1998), are stricdy Fohibited ftom transacting with any minors, meaning pqsons ag€d seventeen (17) and below. Patrons weaxing school uniforms shall be to exhibit any identification which bcars th€ patrol's date ofbirth and presant age. N 54. Each establishments licensed to engage in the business of buying and/or used or second-hand articles of value shall post on its front door or business I ORDINANCE NO. 1I9 SERIES OF 2OOI window, a uniform poster to be secured from the City's Business permits and License Office (BPLO) upon application for business permit or license, or rcnewal thereof The official poster shall be 11" x 17" in size and shall bear the words: .THIS ESTABLISHMENTS DOES NOT DEAL WTH MINONS' CIIAPTER XIV SIDEWALKS/STRIDTS R.EGULATION SECTION 55. It shall be unlar{ul for any person, natural or juddical who occupy any portion of the steets ard,/or sidewalks within the Municipelity of Marikina for purposes other than for puely pedestrian walk, including but not limitcd to the following: brooms, watches or jew€lries, shoes and other footwear, and/or any other it€ms; b. Conduct of shoe-shine occupation; c. Conduct of"rcligious activities", such as preaching and seeking alms; d. Doing housechores such as washing clothes, haaging clothes, and bathing; e. Vehicle garage and/or vehicle repair; f Dumping garbage; Setting of bask€tball coudgoal; h. Usc of sidewalk to install pens of animals or keep animals in chains; i. Storing softdrinks or wine/liquor bottles and cases, drinking liquor and beverages and holding picnics/gatherings; j. Storing ofjunks and recycl€able materials; k. Use of sidewalk for storage of co.struction mate.ials foe sale (pipes, tubings, lumbet cement, and the like); l. House extension o. stall/storc extension including installation of roofs or awrungs; m. lnstallation ofpermanent or picket fence; n. Use of sidewalks for plarts, tees and plant boxes; o. ff Signs signboards on or above sidewalks ard detached from the business establishment; (Sec. 2 ofOrd, No. 59, S. of 1993) SICTION 56, All items foud on sidewalks shall be confiscated by the govemment without prior notice. The same shall be treated as common or ordinary garbage and shall be disposed of as such. The govemment shall thus, not be held tiable for any damage uising fiom the rcmoval, confiscation or disposal of the said items. (Sec. 3 of same 0rdinance-above) $ICIION 57. Any use of sidewalk or a temporary basis and for a definite pe.iod only shall require a special pemit fiom the Municipal Office of Marikina. (Sec. 4 of 0rdinance"above) $ICTION 58. The City Govemment of Marikina provides penalties for harboring or acc€pting rentals from, or allowing the use of frontage of a residential or commercial building by sid 'e twalk or illegal vendors withil the markst zone of Marikina. (Ord. No. Z, of 1997) Senes " ORDINANCE NO. II9 SERIES OF 2OO1 Sf,CTION 59. The spilling ofused oil in canals, skeets, rivar, areeks, and similar areas is hereby prohibited. For of this section, if any person caught violating this section does the same in his capacity as an employee/operato. of a shop, gas station or any business establishmenl, said company, aorporation or business eniity shall be penalized as follows: 1. ) First Ofiense - Susp€nsion of license for a pedod ofone (1) month. 2.) Second Offense - Suspension oflicense for a period ofthree (3) monihs. 3.) Third and Subsequent Offenses - Revocation ofpermit. (Ord. No, 43, S. 1997) SECTION 60, The iDstallation of any commercial sign or billboard which is pdvate in mture h all barangay and city sheets signs arc hercby prohibited in this city. (Ord. No. 103, Series of 1996) CHAPTER XV WASTE MANAGEMENT SEMINAR SECTION 61. All owners and operutols of business and commercial establishments in lhe City of Marikina are hereby required to attend a half-day seminar on solid waste nalag€ment. (Ord. No. 242, Series of 1999) commercial establishments shall refer to those who or,!'n and opemte business required to secue business permit and licensg to operate ftom tha Business Permits and Licensing 0fice of Marikina. Provided, howeveq that in case of big commercial compades or est{blishmcnts, industrial factories, maaufacturing plants and the likes, the assigned or authorized and/or responsible official who handles the waste/garbage disposal ofthe fiIm 0r company, or his designated represedative sha1l be qualified to attend the seminar. $ECTION 63. Tho seninar 04 solid waste management shall be required on: 1.) Ncw applicants for business pemits and license to operat€ and; 2.) Applicants for the renotal ofthe business permit and license to operate, who have not yet undergone the seminar priol to the pass&ge of Ordinance No. 242, Series of 1999. SECIION 64. A 'certificatc of Attendance" issued to the attendecs, shall sewe as proof 0f participation in the seminar, and as a pra-requisite to the is$.rance of the business Fnnit and license to opeiate. The seminar shall be corductod by the Waste Managcmant 0ffice of Marikina aad will covcr a period of four (4) hows. CHAPTER XvI PROEIBITION OF COI,'ORED LAMP/LIGHTS IN MARKET SECTION 65. The use of deceiving colored lamp/lights or colored ellophane/paper/deceiving materials over meat and fish on sale in market stalls (private o lublic) talipepa and ambulant vendors within the city is prohibitecl (Ord. No. 2i, ORDINANCE NO, I19 SERIES OF 2OOI CHAPTIR XVII TAX/PERMIT/LICENSD f, Xf, ,MPTIONS SICTION 66, Cooperatives, The City Business Permit and License Oflic€, the City Assessor's Ofiice ard the City Treaswer's Omce shall strictly comply with Article 63 of R.A. No. 6938 which exempts cooperatives from thc palment of the local tax regardless ofname and naturc. (Res. No. 9, Series of 1999) SECIION 67. Guidelines for the prcyision of Section 66 hereol a.) Article 62 of Republic Act No. 6938, otherwise known as the Cooperative Code of the Philippines and Section 138 of Republic Act NO. 7160, also kno\a! as the Local Govemmeni Code of 1991 provides the following; Article 62, RA. 6938 - Tax and Other Exemptions - Cooperative tansacting business with both members and non-membels.
