Short Title.- This Ordinance shall be known as the 2014 Bicycle Code of Marikina City. SECTION 2. Declaration of Policy.- It is the policy of the City Government of Marikina to protect and promote the health of the people and instill health consciousness among them and to advance the right of the people to a balanced and healthfirl ecology. Likewise, in view of the fluctuating fuel prices in the world market, the city govemment recogrizes the need for cheap altemative means of transportation and encourages the use of non-motorized and environment- friendly modes of ransport like bicycles. SECTION 3. Delnition of Temrs.- For the purpose of this Code, the following terms shall mean: a. Bicycle- means any two-wheeled vehicle having a rear drive which is solely human powered and having a seat height of 25 inches or greater when the seat is in the lowest possible position; b. Bicycle l,ane- means any longitudinal strips designated for passage of cyclists or drivers of non-motorized transport; c. Bicyclist- refers to a cyclist or driver of a bicycle; d. Bike-Friendly Programs and Facilr|ies- means programs, extemal facilities and structures aimed at encouraging and promoting commuting by bicycles and non-motorized transpor! and for substantially and bicycle and non-motorized tansport riden and commut€rs, and which are provided free of charge. te. (.-.yclist- refers to a person who rides a birycle in a competition. h. Driver- means any person who drives a vehicle, motorized or non-motorized; i. Eligible Equipment- means any tool or implement that tend to promote the safety and security of the rider ofa bicycle on non-motorized transport, such as helmets, protective pads and clothing, front and rear lights, reflectors or reflectorized stickers, mirrors, mudguards, carrier racks, straps, chains and locks, tire pumps, appropriate tool kits, tire puncture kits, appropriate batteries and charges. j. Non-Motorized Transport Q'IMT)- means any vehicle, like pedicab, which does not use a motorized engine; k Road- means the entire ofany way, surface or stre€t open to public traffic. SECTION 4. Bicycle Lanes in Marikina City.- Per Ordinance No. 137, Series of 1996, otherwise known as ORDINANCE DESIGNATING BICYCLE LANES ON ALL MAJOR STREETS WITHIN TEE MUNICIPALITY OF MARIKINA, Ordinance No. 56, Series of 2005 entitled ORDINANCE IDENTIFYING TIIE STREETS AND AVENUES IN THE FIRST DISTRICT OF MARIKINA AND PORTION OF BAYAN-BAYANAN AVENUE IN TEE SECOND DISTRICT TEAT WILL INTERCONNECT TEE BICYCLf, I.AI\ES AND SPECIFYING TRAFFIC RULES AND BIKEWAY ROUTES THER"EON, the following streets and avenues are designated bicycle lanes for the exclusive use of cyclists and drivers of NMT: z ^d Ordinance No. 6l Series of2014 Page 3 of7 a. The bicyclists and NMT drivers have the same rights and responsibilities as those of the drivers of motorized vehicles and as such they are obliged to obey the same traffic rules and regulations like the following: . a. Both bicyclist and NMT driver must obey all traffic rules, controls and signals; b. Both must use a fixed, regular seat for riding; c. Bicyclist and NMT driver are hereby required to put or install reflectorizrd stickers or device on their bicycles or pedicabs; d. All bicycle users and NMT drivers are hereby required to wear helmet while riding their bicycles; e. No bicycle and NMT may be used to carrj/ more persons at one time than the number for which it is desiped or equipped; f. At least one hand must be kept on the handlebars while riding; g. Parents and guardians must not knowingly allow a child or minor ward to violate any provisions of this Code; h Every bicycle or NMT must be eCuipped with a brake or brakes which allow the rider to stop within 25 feet from a speed of l0 miles per hour on dry, level, clean bicycle lane; i. A bicyclist or NMT driver using sidewalks or in crosswalks must go down from the bicycle and walk like any pedestrian; j. A bicycle or NMT operated between sunset and sunrise must be equipped with a lamp on the front exhibiting a white light visible from 500 feet to the front and both a red reflector and a larnp on the rear exhibiting a red light visible from 600 feet to the rear; k. A bicyclist or NMT driver must not wear a headsa, headphone, or other listening device other than a hearing aid when riding. Wearing a headset blocks out important audio clues needed to detect the presence of other taffic. l. No cyclist or NMT driver may attach the same or himself or herself to any vehicle upon a roadway. m. A bicyclist or NMT driver propelling a bicycle upon and along a sidewalk, or across a roadway upon and along a crosswalh shall yield the right-of-way to any pedestrian and shall give an audible sigrral before overtaking and passing such pedestrian. n. A person engaged in the business of selling bicycles at retail shall not sell any bicycle unless the bicycle has an identiSing number permanently stamped or cast on its frame. o. A person may not knowingly rent or lease any bicycle to be ridden by a child who is under the age of l6 years unless: /. The child possesses a bicycle helmet; or 2. The lessor provides a bicycle helmet for the child to wear. p. A bicycle or NMT driver may not be used to carry more persons at one time than the number for which it is designed or equipped, except that an adult rider may carry a child securely attached to his or her person in a backpack or sling. q. A bicyclist or NMT driver must carry any pass€nger who is a child under 4 years of age, or who weighs 40 pounds or less, in a seat or carrier that is designed to carry a child of that age or size and that secures and protects the child from the moving parts of the bicycle. - .rd Ordinance No. 61 Series of2014 Page 6 of7 r. Reading or sending text messages on an electronic device while riding a bicycle is prohibited. s. Barangay government units are tasked to clean the bicycle lanes within their territorial jurisdictions and free them from any debris. SECTION 6. Corporate Social Rasponsibility.- Progiafits and facilities of employers, business establishments, schools, and other institutions that are 'bike-friendly" and aimed at encouraging and promoting commuting by bicycles and non-motorized transport (such as but not limited to "bike-to.work" programs), and substantially aiding bicycle and non-motorized transport riders and commuten (such as but not limited to construction of parking areas for bicycles and non- motorized transport vehicles), and which are provided free of charge, may also be treated and deemed.part of their corporat€ social responsibility programs. SECTION 7. Bike-Friendly Programs and Faciliries.-The City Bikeways Office shall come up with periodic Bike.Friendly Programs and Facilities in consultation with bicyclists and NMT drivers especially those coming from the City Council's recogrized or accredited Bikers Clubs. These programs may be adopted by employers, business establishments, schools, and other institutions to be part oftheir corporate social responsibility programs. SECTION 8. Penalty Clause.- The bicyclist or NMT driver at the time of apprehension shall be considered as the owner ofthe bicycle or NMT and shall be penalized as follows: a. Without Helmer a fine of P500.00 b. Without front and rear lights during night biking- a fine of P1@.00 c. Without reflectors or reflectorized stickers, reflectorized vests during night bikng- a fine of P100.00 d. Wearing eyewear ofcycling glasses or goggles is optional. e. If the bicyclist or NMT driver is insolvent at the time of apprehension, he shall be penalized with a community service for four (4) hours to be assigred by any of the implementi ng authorities. f Failure to render community service, he shall be penalized wittt three (3) days imprisonment at the discretion ofthe court g. The cash fines shall be enforced only after one ( I ) year from the date ofits effectivity. SECTION 9. Implementing Authorities.- The City Bikeways Office, the Philippine National Police- Marikina, the Offrce for Public Safety and Security (OPSS) and the Barangay Govemment Units shall strictly enforce this Code Sf,CTION lO. Implementing Rules and Regulations.- Upon approval of this Code, the City Bikeways Office and the City Legal Office shall immediately promulgate the rules and regulations to effectively implement the provisions ofthis Code. SECTION ll. Separability Clause.- If any provision/s of this Code are declared as unconstitutional or inconsistent with the provisions of any national law or executive order the remaining provisions shall remain valid and effective. SECTION 12. Repealing Clause.- All previous ordinances which are inconsistent with the provisions ofthis Code are hereby repealed or amended accordingly. SECTION 13. Efectwity Clarzse.- This Code shall take effect immediately upon approval.
