WHEREFORE, after carefully weighing the evidence at hand, accused [XXX263779] is hereby found guilty beyond reasonable doubt of the crime charged. Accordingly, he is sentenced to an indeterminate penalty of Six (6) months and One (1) day to Six (6) years. He is further ordered to pay private complainant the sum of Fifty Thousand Pesos (Php50,000.00) as moral and exemplary damages without subsidiary imprisonment in case of insolvency.
