WHEREFORE , in view of the foregoing, the Omnibus Motion to Declare Complaint as Nuisance Suit and to Order the Payment of the Correct Docket Fees filed by the defendant is hereby GRANTED . Accordingly, the Complaint for the Declaration of Inexistence of the Contract on Conveyance of Shares of Stocks under Article 1410 of the Civil Code filed by the plaintiff is hereby DISMISSED . SO ORDERED.
