WHEREFORE , premises considered, there being an incomplete self-defense, ACCUSED, Daniel Aquino y Espiritu, is found GUILTY beyond reasonable doubt of the crime of Homicide. Pursuant to Article 69 of the Revised Penal Code and applying the Indeterminate Sentence Law, he is hereby sentenced to suffer the penalty of imprisonment of four (4) years and two (2) months of prision correccional medium, as minimum, to eight (8) years of prision mayor minimum, as maximum.

Pursuant to Article 69 of the Revised Penal Code and applying the Indeterminate Sentence Law, he is hereby sentenced to suffer the penalty of imprisonment of four (4) years and two (2) months of prision correccional medium, as minimum, to eight (8) years of prision mayor minimum, as maximum. He is likewise ordered to pay the heirs of the victim, Lorwin Cordovez, the following amounts; (a) [PHP]50,000.00 as civil indemnity; (b) [PHP]50,000.00 as moral damages; (c) [PHP]50,000.00 as exemplary damages; and (d) [PHP]27,500.00 as actual damages. The damages awarded shall earn interest at the rate of 6% per annum from the date of the finality of this judgment. SO ORDERED.
