WHEREFORE, in SB-17-CRM-2140 , accused ABDUL AZIZ M. PANGANDAMAN, ESTELITO A. NIERVA, RUBEN A. BESMONTE, NEOFITO C. PERILLA, DIVINA GRACIA D. DANTES, CESAR L. BOCANOG, and MARIO a.k.a. "MARLO" D. ARIAS are found GUILTY beyond reasonable doubt of violation of Sec. 3(e) of R.A. 3019 and are sentenced to suffer the indeterminate penalty of IMPRISONMENT of SIX (6) YEARS and ONE (1) MONTH as minimum to TEN (10) YEARS as maximum with perpetual disqualification to hold public office. For failure of the prosecution to prove the guilt beyond reasonable doubt of accused JUNIO NORBERTO M. RAGRAGIO and ROSENDO C. CALLEJA , they are ACQUITTED of the crime of Violation of Sec. 3(e) of R.A. 3019. Likewise, in SB-17-CRM-2141 , accused ABDUL AZIZ M. PANGANDAMAN, ESTELITO A. NIERVA, RUBEN A. BESMONTE, NEOFITO C. PERILLA, DIVINA GRACIA D. DANTES, CESAR L. BOCANOG, and MARIO a.k.a. "MARLO" D. ARIAS are found GUILTY beyond reasonable doubt of violation of Sec. 3(e) of R.A. 3019 and are sentenced to suffer the indeterminate penalty of IMPRISONMENT of SIX (6) years and ONE (1) MONTH as minimum to TEN (10) YEARS as maximum with perpetual disqualification to hold public office. The bail bonds posted by the accused Ragragio and Calleja are ordered released subject to the usual accounting procedures. The Hold Departure Order issued by this Court on November 17, 2017 is set aside and the Order issued by the Bureau of Immigration incorporating the names of the accused in the Hold Departure List is ordered recalled and cancelled. SO ORDERED.
